HomeMy WebLinkAbout0741ORDINANCE NO. 741 (1978 Series) AN ORDINANCE OF THE CITY OF SAN LUIS OBISPO AMENDING SECTIONS 4226.10 AND 4287 OF MUNICIPAL CODE ARTICLE IV, CHAPTER 2. (PARK REGULATIONS) and (MAIL BOXES). BE IT ORDAINED by the Council of the City of San Luis Obispo as follows: SECTION 1. Article IV,. Chapter 2, Section 4226.10 of the Municipal Code is hereby amended to read as follows: "SECTION 4226.10. ENFORCEMENT. The Police Department shall have the primary responsibility for the enforcement of the provisions of this Chapter, including all violations of State law occurring within City 'parks. In addition, ..all personnel in the Park & Recreation Department and all Public Services Department personnel in the Parks Division shall have the duty to enforce the provisions of Sections 4226.3(a) (2), 4226.3(b), 4226.3(c), 4226.3(d) and 4226.4, and all of such persons shall have the powers and duties of a deputy poundmaster for the purpose of enforcing the City's animal control regulations (Municipal Code Sections 4000 et seq.) within City parks. For the purposes of such enforcement, said personnel are authorized to arrest persons and issue citations in accordance with the provisions of Government Code Section 36900." SECTION 2. Article IV, Chapter 2, Section 4287 of the Municipal Code is hereby amended to read as follows: "SECTION 4287. NO MAIL BOXES IN SIDEWALK AREAS. (a) In a residential zone, it shall be unlawful for any person to install or maintain, or to direct, authorize, or permit the installation or maintenance of, a mail box, a receptacle for newspaper delivery, or any other container to be used for delivery purposes, in, upon or over any portion of the space or area between a street curb and the back edge 0 741 ORDINANCE NO. 741 of an improved sidewalk. (b) Any such container found within said space or area shall be deemed to be an encroachment which may be summarily removed by the City fifteen (15) days after mailing written notice to the occupants of the residence or residences situated nearest thereto, unless said occupants shall then possess a valid City approval. (c) Enforcement: This section shall be enforced by the Director of Public Services." SECTION 3. This Ordinance, together with the ayes and noes, shall be published once in full, at least three (3) days prior to its final passage, in the Telegram- Tribune, a newspaper published and circulated in said City, and the same shall go into effect at the expiration of thirty (30) days after its said final passage.
