HomeMy WebLinkAbout0755ORDINANCE NO. 755 (1978 Series) AN ORDINANCE OF THE CITY OF SAN LUIS OBISPO AMENDING THE OFFICIAL ZONE MAP OF THE CITY (TO REZONE PROPERTY NORTH AND EAST OF BUENA VISTA AVENUE, CITY- INITIATED REZONING) WHEREAS, the Planning Commission and Council have held hearings to consider appropriate zoning for subject property in accordance with Section 65800 et. seq. of the Government Code, and; WHEREAS, the Council has initiated an amendment to the general plan which will be consistent with the proposed zoning and this zoning action will reduce the degree of inconsistency with the adopted general plan, and; WHEREAS, the proposed zoning promotes the public health, safety and general welfare, and; WHEREAS, the use permit requirement is necessary to enable review of hillside development and adequacy of public utilities and services: BE IT ORDAINED by the Council of the City of San Luis Obispo as follows: SECTION 1. That the portion of the City of San Luis Obispo as shown on the Official Zone Map of the City be reclassified from R -1 (Low- Density Resi- dential) to R -1 -S (Low- Density Residential, use permit required due to special considerations) as shown on the attached map marked Exhibit A and included herein by reference. SECTION 2. This ordinance, together with the ayes and noes, shall be published once in full, at least three (3) days prior to its final passage, in the Telegram- Tribune, a newspaper published and circulated in said city, and the same shall go into effect at the expiration of thirty (30) days after its said final passage. SITUATION: When the City Council considered the Planning Commission report on this area, they decided not to add the "S" designation to one parcel on McCollum Street, as shown on the following map. The city attorney advised us that the item had to come back for Planning Commission report since the action of the council was not the same as the action of the Planning Comm - ission. While the council also did not accept the commission's recommendation on most of the property (they approved R -1 -S for the entire area recommended to be A /C -5) this issue need not be discussed again since it has already been considered by the Planning Commission. ° RECOMMENDATION: Since development of this parcel is not a critical issue to development of the remaining hillside area at the ends of Slack Street and Hays Street, and it is a single parcel under separate ownership, there is no need to apply the special considerations use permit requirement.
