HomeMy WebLinkAbout0766ORDINANCE NO. 766 (1978 Series) AN ORDINANCE OF THE CITY OF SAN LUIS OBISPO AMENDING THE OFFICIAL ZONE MAP (TO REZONE PROPERTY AT 1426 AND'1426 1/2 BROAD STREET FROM R -2 TO PO, R. CARSEL, APPLICANT). WHEREAS, the applicant requested rezoning of a single par- cel of property from R -2 (Residential) to PO (Professional Office); and WHEREAS, the Planning Commission at a public hearing held May 3, 1978, passed a resolution denying the change of zone; and WHEREAS, the applicant appealed the Planning Commission denial on the basis that (1) information given to the commission was inaccurate and (2) assumptions made by the commission about the precedent- setting nature of the rezoning were incorrect; and WHEREAS, the City Council held a public hearing on the matter, taking testimony for and against the rezoning; and WHEREAS, the City Council finds that the rezoning would be appropriate for the area by encouraging preservation of a _istorically significant structure as an office; and WHEREAS, the proposed rezoning will promote the public health, safety and general welfare of the city; and plan; WHEREAS, the .proposed rezoning is consistent with the general NOW, THEREFORE, BE IT ORDAINED by the Council of the City of San Luis Obispo as follows: SECTION 1. That the following described portion of the City of San Luis Obispo as shown on the Official Zone Map of the City, and also shown on the map attached hereto marked Exhibit "A" and incorporated herein by reference, be reclassified as follows: 0 766 Ordinance No. 766 (1978 Series) From District R -2 (medium density residential) to PO (pro- fessional office) District, real property described as: That portion of Lot 10, Block 89 of Murray and Church Addition in the City of San Luis Obispo, State of California, according to map filed September 27, 1877, in Book A, page 144 of Maps, in the Office of the County Recorder described as follows: Beginning at a point on the easterly line of Broad Street in said City of San Luis Obispo, said point being 95.5 feet northerly from the northeasterly corner of Broad and Buchon Streets, and also being the southerly corner of Lot 10 in Block 89 of said City; and running thence north- easterly on the line between Lots 10 and 11 in said Block 89, 100 feet; thence at right angles northwesterly and parallel with the line of Broad Street 50 feet to the line between Lots 9 and 10 of said block; thence at right angles southwesterly on the line between said Lots 9 and 10, 100 feet to the easterly line of Broad Street; thence southeasterly along the easterly line of Broad Street 50 feet to the point of beginning. General Location: 1426 and 14261/2 Broad Street SECTION 2. This ordinance, together with the ayes and noes, shall be published once in full, at least three days prior to its final passage, in the Telegram- Tribune, a newspaper pub- lished and circulated in said city, and the same shall go into effect at the expiration of thirty days after its said final passage.
