HomeMy WebLinkAbout0779ORDINANCE NO. 779 (1978 SERIES) AN ORDINANCE OF THE CITY OF SAN LUIS OBISPO AMENDING THE OFFICIAL ZONE MAP (TO REZONE PROPERTY AT 1106 OCEANAIRE BE IT ORDAINED by the City Council of the City of San Luis Obispo as follows: SECTION 1. That the following described portion of the City of San Luis Obispo as shown on the Official Zone Map of the City of San Luis Obispo be re- classified as follows: Said property is also shown on the map attached hereto marked Exhibit "A" and incorporated herein by reference. From District R -2 -S (Residential Medium Density,Special Considerations) to R -2 -PD (Residential Medium Density, Planned Development) real property described as: Parcel 1 of parcel map SLO AL 78 -28. Being a portion of lot 78 of tract 465 as recorded in Book 9, Page 27 of maps and a portion of lots Y, Z + AA of lots 58, 61, 62, 63, 64, and 65 of RR Harris Subdivision of the Ranchos Canada de los Osos and La Laguna, as recorded in Book "A" at page 161 of maps, in the City of San Luis Obispo, California. Meets and Bounds Description - Beginning at the monument at the inter- section of Oceanaire Drive and Los Osos Valley Road in the City of San Luis Obispo, thence proceeding along the center line of Oceanaire Drive N45 °46'02" E a distance of 107.42'; thence N44 °13'58" W, 30.00' to a point on the north westerly right -of -way line of Oceanaire Drive and the true point of beginning; thence along the right -of -way of Oceanaire Drive S45 °46'02" W, 27.81' to the beginning of a curve to the west of radius 30.00', length 47.12' and angle 90 °00'; thence along the north - easterly right -of -way line of Los Osos Valley Road bearing N44 °13'58" W, 400.90'; thence N7 °03'52" E, 87.54'; thence N58 °21'42" E, 381.66'; thence N45 °42'57" W, 254.98' to the northwesterly right -of -way line of Oceanaire Drive; thence along said right -of -way line along a curve to the south of radius 380.00', length 209.90' and angle 31 °3855 "; thence along a curve to the west of radius 320.00', length 213.44'and angle 38 °12'55" to the point-of the beginning. 0 779 Ordinance No. 779 1978 Series General location: 1600 Oceanaire Approval of said rezoning is subject to the following conditions: Conditions: (1) The project shall receive preliminary approval by the Architectural Review Commission (2) The applicant shall be given a period of six months to file a tentative tract map and 18 months to file precise development plan for city approval. Preli- minary development plan approval shall become null and void after 18 months if precise development plan is not filed and approved. (3) The project shall be 'built -out' in a single phase. Construction shall com- mence with 12 months from the date of approval of final tract map and shall be pursued in a timely fashion. (4) The applicant shall submit draft declaration of covenants, conditions and restrictions (CC &R's) and documents related to the creation of a homeowner's association at the time of filing tentative tract map, for review and approval by the community development director and city attorney. The CC &R's shall con - tain.the following provisions: (a) a homeowner's association to enforce the CC &Rs_ and provide for professional, perpetual maintenance of all common areas including landscaping, building, exteriors, private driveways, lighting, walls, fences, etc., in first -class condition; (b) a right of the City of San Luis Obispo to compel performance if the home- owner's association fails to perform and assess the homeowner's association for expenses incurred; (c) no parking in private driveways except in approved designated spaces; (d) a grant to the City of San Luis Obispo the right to tow away vehicles on a complaint basis, which are parked in unauthorized places; (e) no outside storage of boats, campers, motorhomes, trailers, or inoperable vehicles; (f) no unscreened outside storage by individual units; (5) The private streets shall be improved to standards approved by the city engineer. (6) All utilities shall be underground. (7) Each unit shall have individually metered water service. Meters shall be located adjacent to private streets. (8) Water and sewer service to each unit may be provided by extension of public mains on private property. Mains shall be constructed to city standards and easements granted to thecity subject to the approval of the city engineer. Ordinance No. 779 1978 Series SECTION 2. This Ordinance, together with the ayes.and noes, shall be pub- lished once in full, at least three days prior to its final passage, in the Telegram- Tribune, a newspaper published and circulated in said City, and the same shall go into effect at the expiration of thirty days after its said final passage.
