HomeMy WebLinkAbout08121 follows: ORDINANCE NO. 812 (1979 Series) AN ORDINANCE OF THE CITY OF SAN LUIS OBISPO ADDING SECTION 4226.11 TO MUNICIPAL CODE ARTICLE IV, CHAPTER 2, TO PROVIDE RULES FOR THE USE OF MISSION PLAZA. BE IT ORDAINED by the Council of the City of San Luis Obispo as SECTION 1. Municipal Code Article IV, Chapter 2, is amended hereby by adding Section 4226.11 to read as follows: "SECTION 4226.11. MISSION PLAZA. The provisions set out in this section apply to the use of Mission Plaza. Unless specifically provided to the contrary, the rules and regulations set out in this section are additional to the city parks rules and regulations set out in Sections 4226.3 through 4226.10. (a) Mission Plaza Coordinator of Events. The council shall appoint a Mission Plaza Coordinator of Events to perform the duties assigned by this section, and to perform such other duties as the council or Director shall assign from time to time. (b) General Regulations. (1) No event promoter or vending promoter shall be allowed to use Mission Plaza for profit.. (2) No individual or non - profit organization may use a private paid promoter to organize a vending program in Mission Plaza. (3).Non- profit clubs, organizations, service,clubs,.or any individual organizer requesting use of Mission Plaza for a program involving vending of food, drink, or arts and crafts must reside in or have headquarters in the city. (4) Individual vendors selling food, drink, or arts and crafts must reside in or have headquarters in the County of San Luis Obispo, 0 812 REPEALED Ordinance No. 812 (1979 Series) provided that the Mission Plaza Coordinator of Events shall organize one "Annual Open Event" which may be open to all interested participants, subject to space available. (S) Only non - profit groups or organizations will be allowed to vend food or drink products in Mission Plaza. (6) No form of resale will be allowed in Mission Plaza. (7) Events or programs where craft - vending is the primary activity will not be scheduled more than once each month and will not exceed six (6) such events per calendar year. The six allowable yearly programs will include those events called for by contract with the Mission Plaza Coordinator of Events, but shall not include the annual La Fiesta celebration. (8) Nothing herein is intended to excuse any prospective Mission Plaza vendor from obtaining permits or licenses required by the City, County of San Luis Obispo,,or the State of California. (9) Notwithstanding Section 4226.4, application for use of Mission Plaza must be filed with the Mission Plaza Coordinator of Events no fewer than 30 or more than 180 calendar days in advance of the intended use. (10) Application for street closure must be filed with-the City Clerk at least 30 days in advance.of the event. (c) The council by resolution may adopt additional procedural rules regarding the use of Mission Plaza, including but.not limited to fee schedules for vending booths and displays." SECTION.2. This ordinance, together with the ayes and noes, shall be published once in full, at least three days prior to its final passage, in the Telegram - Tribune, a newspaper published and circulated in said City, and the same shall go into effect at the expiration of thirty days after its said final passage. -2- ,u Ordinance No. 812 (1979 Series) provided that the Mission Plaza Coordinator of Events shall organize one "Annual Open Event" which may be open to all interested participants, subject to space available.
