AN INTERIM URGENCY ORDINANCE OF THE CITY OF
OF SAN LUIS OBISPO ESTABLISHING A MORATORIUM
ON THE CONVERSION OF HOUSING IN THE DOWNTOWN
AREA.
WHEREAS, the City Council is aware the housing in the downtown area of
San Luis Obispo fulfills basic housing needs of many senior citizens and other
low - income households; and
WHEREAS, the City Council is aware that there are economic and land use
pressures which mdy encourage landlords-'in the downtown area to convert housing
units to offices or commercial use; and
WHEREAS, the City Council is concerned about the health and general welfare
of low- income residents in the downtown area'who would be displaced by the
conversion of existing housing units; and
WHEREAS, the City Council considered the displacement of these households
a hardship since there is little available or affordable replacement housing for
these people in the City; and
WHEREAS, the City Council has directed the staff to work with the San Luis
Obispo Housing Authority to evaluate various zoning and other proposals which can
help conserve housing in the downtown.
BE IT ORDAINED by the Council of the City of San Luis Obispo as follows:
SECTION 1. Pursuant to Section 65858 of the California Government Code,
the City Council hereby establishes a one year moratorium on the issuance or
granting of any permit or other entitlement which would enable or assist the
conversion of existing housing units in the downtown area to office, commercial,
or other non - residential use.
SECTION 2. For the purpose of this moratorium, the downtown area is that
area delineated on Exhibit A,'attached hereto and incorporated herein by
this reference.

SECTION 3. This ordinance is declared to be an ordinance fog the immediate
protection and preservation of the public safety, health and welfare. Facts in
support of the urgency of this ordinance are as follows:
A. An urgency measure is necessary to prohibit conversion of downtown housing
to office, commercial and other non - residential use, in order to assure
that people of limited means and income will not be displaced without
the availability of adequate., affordable replacement housing.
B. At least one application for the conversion of downtown housing is now
on file with the City; unless this ordinance is passed immediately,
there is a strong likelihood that a number of city residents will be
displaced from their current residences without the availability of
adequate, affordable replacement housing.
SECTION 4. This ordinance being an emergency ordinance for the immediate
protection and preservation of the public health, safety and general welfare,
containing a declaration of the facts constituting the urgency and passed by a four -
fifths (4/5) vote of the Council shall take effect immediately pursuant to Charter
Section 605 and, having been noticed as required by Section 65858 of the Government
Code, shall continue in effect for a period of one year.
SECTION 5. The City Clerk shall cause this ordinance to be published within
five (5) days in a newspaper of .,general circulation, but delay in publication,
or even failure to publish, shall not affect its validity.
SECTION 6. This ordinance may be rescinded by the City Council at any
time by majority action of this Council.
