ORDINANCE NO. 831 (1979 series)
AN ORDINANCE OF THE CITY OF SAN LUIS OBISPO
AMENDING THE OFFICIAL ZONE MAP TO PREZONE
PROPERTY AT 4280 SOUTH HIGUERA STREET FROM
A -1 -10 (COUNTY;ZONING) TO R -2 -PD (APPLICANT:
HOUSING AUTHORITY OF SAN LUIS OBISPO)
WHEREAS the San Luis Obispo Housing Authority is desirous of construc-
ting a 15 -unit apartment project on a 1.73 acre area at 4280 South Higuera
Street and
WHEREAS the Planning Commission has conducted public hearings on the
request and has recommended zoning consistent with the applicant's request,
and
WHEREAS the prezoning has been evaluated in accordance with the
California Environmental Quality Act and the City's Environmental Impact
Procedures and Guidelines, and a negative declaration has been granted by
the City, and
WHEREAS the proposed prezoning promotes the public health, safety and
general welfare;
BE IT ORDAINED by the Council of the City of San Luis Obispo as
follows:
SECTION 1. That the area proposed for annexation to the City of San
Luis Obispo be shown on the official zone.map of the City of San Luis Obispo
as shown on the attached map marked Exhibit "A" and included herein by
reference.
From County A -1 -10 zoning to City R- 2- Residential Medium - Density
Planned Development real property described as follows:
A portion of Lot 3 in Section 10, Township 31 South,-Range 12 East,
Mount Diablo Base and Meridian, in the County of San Luis Obispo, State of
California, according to the official plat of the survey of said.land approved
by the Surveyor General on December 13, 1875, described as follows:

Beginning at a point on the westerly line of South Higuera Street as
it existed January 1, 1933 and the intersection with the northerly line of
Rancho Santa Fe; thence northeasterly along said westerly line, North 290 30'
08" East, 600.00 feet to the most northeasterly corner of a parcel of land
recorded in Volume 59 of Official Records at Page 305 recorded in said County
and State; thence North 680 16' 52" West, 219.84 feet along the northerly line
of the project described in Volume 59 of Official Records at Page 305 to the
easterly line of the subdivision of Tract 467 Unit No. 2, recorded in Book 8
of Maps at Page 73 in said County and State; thence northeasterly along said
easterly line of Tract 467, North 290 30' 18" East, 347.44 feet to an angle
point in the boundary of said Tract 467; thence southeasterly along said line,
South 680 14' 58" East, 217.60 feet; thence along the extensioncof previous
line, South 680 14' 58" East, 40.46 feet to the easterly line of said South
Higuera Street; thence southwesterly along th easterly line of said South
Higuera Street, South 290 30' 08" West, 347.28 feet to a point; thence westerly
along the extension of the northerly line of the property described in Volume
59 of Official Records at Page 309 recorded in said County and State, North
680 16' 52" West, 50.46 feet to the True Point of Beginning.
Said parcel contains 2.14 acres +.
General location:
4280 South Higuera Street, as depicted on the attached map.
Approval of said prezoning is subject to applicant's preliminary
development plan and the following conditions:
Conditions:
1. The project shall receive approval by the Architectural Review Commission,
who shall also address the issue of requiring fencing of the site at
appropriate locations.

2. The applicant shall be given a period of 12 months to file precise
development plan for city approval. Preliminary development plan
approval shall become null and void after 12 months if precise develop-
ment plan is not filed and approved.
3. The project shall be "built -out" in a single phase. Construction shall
commence within 12 months from the date of approval of a precise
development plan and shall be pursued in a timely fashion.
4. Applicant shall dedicate 17' along South Higuera frontage for street
widening.
5. Applicant shall provide 33 parking spaces.
6. Applicant shall provide a fire alarm hookup to the satisfaction of the
Fire Department.
SECTION 2. This ordinance shall not become effective until the
official annexation of the territory depicted in Exhibit "A" to the City.
SECTION 3. This ordinance, together with the ayes and noes, shall be
published once in full, at least three days prior to its final passage, in
the Telegram- Tribune, a newspaper published and circulated in said City.

Obispo at a regular meeting thereof held on the 20th day of November
on motion of Councilman Jorgensen , seconded by Councilman Bond ,
and on the following roll call vote:
AYES: Councilmembers Jorgensen, Bond; Billig, Dunin and Mayor Cooper
