HomeMy WebLinkAbout0858ORDINANCE NO. 858 (1980 Series) AN ORDINANCE OF THE CITY OF SAN LUIS OBISPO AMENDING VARIOUS PROVISIONS OF ARTICLE IX, CHAPTER 7 OF THE SAN LUIS OBISPO MUNICIPAL CODE, SIGN REGULATIONS BE IT ORDAINED by the council of the City of San Luis Obispo as follows: SECTION 1. Section 9702.2.B. of the San Luis Obispo Municipal Code hereby is amended, to read as follows: "Section 9702.2.B. Official federal, state or local government traffic, directional and informational signs and notices issued by any court, person or officer in performance of a public duty, or any other sign that is required to be posed by any government agency.' SECTION 2. Subsection 0 hereby is added to Section 9702.2 of the San Luis Obispo Municipal Code, to read as follows: "Section 9702.2.0. Signs showing the location of public telephones and signs placed by utilities to show the location of underground facilities." SECTION 3. Section 9702.3.G. of the San Luis Obispo Municipal Code hereby is amended, to read as follows: "Section 9702.3.G. Signs made wholly or partially of highly reflective material, except energy- saving reflective material, and fluorescent painted signs." SECTION 4. Section 9702.3.H. of the San Luis Obispo Municipal Code hereby is amended,,to read as follows: "Section 9702.3.H. Any sign which does not conform with the following clearance requirements for communication lines, utility lines and power lines, provided that further restrictions adopted by the California Public Utilities Commission shall be followed: Minimum Clearance of Signs From Conductors Less Than Greater Than or 750 Volts Equal to 750 Volts Vertical Clearance Above Sign 3 feet 8 feet Below Sign 3 feet Prohibited Horizontal Clearance From Conductors 3 feet 6 feet From Poles 4 feet 6 feet" r t Ordinance No. 858 (198( ,ries) Page 2 SECTION 5. Section 9704.3.C. of the San Luis Obispo Municipal Code is amended, to read as follows: "Section 9704.3.C. The following signs are permitted in the Retail Commercial information (C -R) zone district. Total area of signs, exclusive of shopping center /signs, shall not exceed 200 square feet for each business or tenant. Each business or tenant may have four signs from the following and may place them on any wall: (1) Wall /window signs. The total area of all wall /window signs on a single building face may not exceed 15 percent of the building face nor exceed 100 square feet. Wall /window signs may not be located above the second story. (2) Suspended signs, not to exceed 10 square feet each. (3) Projecting or marquee signs, not to exceed 24 square feet each. (4) Directory signs as provided in Section 9704.2.B.(3). SECTION 6. Section 9704.3.E.(2)(b) of the San Luis Obispo Municipal Code is hereby amended,.to read as follows: "Section 9704.3.E.(2)(b). One free - standing sign at.each premises not to exceed 25 feet in height or 72 square feet in area. This sign may be located within the required yard area on lots where buildings existed on or before. September 1, 1980 are in the required yard area." SECTION 7. Section 9705.3. of the San Luis Obispo Municipal .Code hereby is amended to read as follows: "Section 9705.3. Amortization of Non - Conforming Signs. A. Signs which do not conform to the provisions of these regulations but which lawfully existed and were maintained prior to September 3,-1977, shall be removed or made to conform within 60 days after written notice by the Department of Community Development, in accordance with the following schedule: If Twice the Original Value of Sign Is: The Amortization Period Is: Less than $500 Two years $500 to $999 Three years $1,000 to $2,999 Five years $3,000 to $5,999 Eight years Greater than $6,000 Ten years Ordinance No. 858 (1980 Series) Page 3 B. The time periods in the above schedule shall commence September 3, 1977. C. If a sign becomes non - conforming due to the amendment of these regulations, the period for abatement shall be measured from the effective date of the amendment. D. If more than one sign on a premises is,or becomes non - conforming, the original cost of all such non - conforming signs shall be aggregated for the purpose of determining the amortization period. E. The owner or user of a non - conforming sign shall, upon written request of the Department of Community-Development, furnish acceptable proof-of the. initial cost in the form of (1) an original bill of sale, (2) a depreciation schedule from state or federal income tax returns', or (3) a written appraisal by a sign manufacturer." SECTION 8. Section 9707 hereby is added to the San Luis Obispo Municipal Code, to read as follows: "Section 9707. Appeals. Section 9707.1. Architectural Review Commission Appeals. Any decision of the Architectural Review Commission may be appealed in accordance with the procedures set out in Section 9500.02.F. Section 9707.2. Community Development Department Appeals. Any decision of the Community Development Department may be appealed in accordance with the provisions set out in Section 1400 et seq." .SECTION 9. This Ordinance, together with the ayes and noes, shall be published once in full, at least three (3) days prior to its final passage in the Telegram- Tribune, a newspaper published and circulated in said city, and the same shall go into effect at the expiration of thirty (30) days after its said final passage.
