HomeMy WebLinkAbout0951• ORDINANCE NO. 951 (1983 SERIES) AN ORDINANCE OF THE CITY OF SAN LUIS OBISPO PROHIBITING THE EXTENSION OF WATER & SEWER SERVICES FOR PRIVATE USE OUTSIDE OF THE CITY LIMITS. WHEREAS, the City Council wants to formalize a longstanding City policy; and WHEREAS, imprudent development on the periphery of the City can nullify the City's best long -term planning efforts and endanger the health, safety and welfare of City residents and businesses; and WHEREAS, on December 6, 1982, San Luis Obispo County has approved developments adjacent to the City limits which were premature and ill - advised, and which will result in predictably certain health and safety problems such as: waste disposal system failures, water quality degra- dation, inadequate fire flow capability, geological instability, erosion, increased runoff, inappropriate grading, and hillside scarring, not only for existing City residents but also for residents of said new developments; and WHEREAS, existing General Plan and public service policies support provision of water and sewer service to new development only when it is within the city limits; and WHEREAS this Council deems it necessary and appropriate to enact legislation establishing and clearly enunciating City policy so that the future residents, the developers, the county and the appro- priate state agencies will recognize that the City will not authorize such extensions of service. NOW AND THEREFORE, be it ordained by the San Luis Obispo City Council as follows: SECTION 1. After the effective date of this Ordinance, the 0 951 Ordinance No. 951 (1983 Series) Page 2. City shall not approve any provision of or entitlement to water or sewer service for the use or benefit of properties outside the city limits. SECTION 2. This Ordinance shall not apply to: (A) any property duly annexed after the effective date of this ordinance; (B) Any public or private party with which the City had an effective agreement for provision of services prior to the effective date of this ordinance; (C) Properties which currently receive city water or sewer service without a previously effective agreement. (D) Provision of sewer service to the Hidden Hills Mobile Home Park, as provided in the State of California Water Resources Control Board Order No. WOG 82 -6. SECTION 3. The City Clerk is directed to send a copy of the final ordinance to the State Water Resources Board, Regional Water Quality Control Board, County Health Department, County Board of Supervisors and all title companies in the county. INTRODUCED AND PASSED to print by the San Luis Obispo City Council at a meeting held on the 1st. day of February , 1983 on a motion of Councilman Settle and seconded by Councilman Griffin and on the following roll call vote: AYES: Councilmembers Settle, Griffin, Dovey, Dunin and Mayor Billig NOES: None ABSENT: None �.
