AN ORDINANCE OF THE COUNCIL OF THE CITY OF
SAN LUIS OBISPO ADDING SECTION 4816 (APPLICATION
TO ADULT THEATRES AND ADULT BOOKSTORES) TO THE
SAN LUIS OBISPO MUNICIPAL CODE
BE IT ORDAINED by the Council of the City of San Luis Obispo as follows:
SECTION 1. Section 4816 hereby is added to the San Luis Obispo Municipal
code to read as follows:
"SECTION 4816. APPLICATION TO ADULT THEATRES AND ADULT BOOKSTORES.
With respect to adult theatres and adult bookstores applying for a license
and permit under the terms of this chapter, the Council shall make no determination
on such application without first considering a report of the City Attorney concerning
the appropriateness of applying the standards set out in this chapter. If so advised
by the City Attorney that any or all standards set out in this chapter may not properly
be applied to the adult bookstore or adult theatre application, the Council shall not
apply such standards."
SECTION 2. This Ordinance, together with the ayes and noes, shall be published
once in full, at least three (3) days prior to its final passage in the Telegram- Tribune,
a newspaper published and circulated in said City, and the same shall go into effect
at the expiration of thirty (30) days after its said final passage.
INTRODUCED AND PASSED TO PRINT by the Council of the City of San Luis Obispo
at a meeting held on the 19th day of April , 1983, on motion of Councilman Griffin
seconded by Councilman Settle , and on the following roll call vote:
AYES: Councilmembers Griffin, Settle, Dunin and Mayor Billig
NOES: None
ABSENT.:. Councilwoman Dovey
