office holder status as of June 30, 1999. They State deadline was July 31, 1999, however, no
penalties will apply as this office inadvertently neglected to provided you with the opportunity to
file in a timely manner.
The Form 470 is filed only in the City Clerk's Office, not with the California Secretary of State.

SUBJECT: APPOINTMENT TO COUNCIL VACANCY
CAO RECOMMENDATION: 1) Nominate an applicant to an unexpired Council Member
term ending December 1, 2000; and, 2) adopt resolution appointing aforementioned Council
Member.
DISCUSSION
On August 18, 1998, the City Council adopted a process for making an appointment to the City
Council to fill an unexpired term created by the resignation of Kathy Smith. At that time, a
public hearing was set for September 8, 1998 to consider applicants to this position.
During the week of August 24`x• the City Clerk received statements from nine citizens requesting
appointment to this unexpired term which ends on December 1, 2000. They are:

Charlie Senn
Lark Jursek
Orval Osborne
Christine Mulholland
The applicants are listed above in the order of the randomized alphabet drawn by the Secretary of
State on August 13, 1998. This is the order in which each will be asked to address the Council
for five minutes stating their willingness to serve and presenting their qualifications. The
Council may ask questions of the candidates at this time.
After the applicants have spoken, each Council Member will be asked to circle three names on a
transparency containing the names of the nine applicants. The transparencies will then be placed
on the overhead and the City Clerk will tally the votes. The name of the candidate receiving the
most votes will be nominated and a vote taken. If this motion carries, the council will take a
separate vote on a resolution making the appointment.

In the event the Council cannot reach agreement on an appointment, the item may be continued
throughout the month of September. If no appointment has been made by September 30d;
Council must call a special election to be held in January, 1999.
FISCAL IMPACT
If the Council makes an appointment to fill this vacancy, the fiscal impact would be minimal.
However, a special election, whether conducted for the City by the County Elections Division or
an election contractor, is estimated to cost from $65,000 to $75,000.

A RESOLUTON OF THE CITY COUNCIL OF THE CITY
OF SAN LUIS OBISPO MAKING AN APPOINTMENT
TO FILL THE OFFICE OF COUNCIL MEMBER OF THE]
CITY TO FILL A VACANCY CREATED BY THE RESIGNATION
OF KATHY SMITH
WHEREAS, Kathy Smith was duly elected to the Office of Council Member of the City
of San Luis Obispo to a four-year term at the General Municipal Election held on November 8,
1996; and
WHEREAS, Kathy Smith resigned from the City Council effective August 31, 1998; and
WHEREAS, qualified electors have been nominated to this Council for appointment to
the Office of Council Member to fill the vacancy created by the resignation of Kathy Smith, for
the balance of the unexpired term, which is December 1, 2000, under the terms of the City of San
Luis Obispo Charter Section 405; and
WHEREAS, the Council has considered and reviewed the applicants;
NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS:
SECTION 1. The Council hereby appoints
to the office of
Council Member of the City of San Luis Obispo, to fill the vacancy created by Kathy Smith's
resignation, for the remainder of Ms. Smith's unexpired term, to wit, until noon, December 1,
2000.
SECTION 2. This appointment will become effective immediately upon adoption of this
resolution.

I believe it is important that we have ground rules in place prior to proceeding with the
appointment of an individual to complete Kathy Smith's unexpired term. This will reduce the
perception that we are making up rules during the process in order to achieve a political
advantage and should also assure that the appointment.process proceeds smoothly, thus avoiding
the expense of a special election. As a point of departure, I suggest the following ground rules be
considered at the beginning of the meeting:
(First Ballot:
• Nine candidates, each council member votes for three.
• If no candidate gets three votes on the first ballot, proceed to a second ballot
considering only those candidates receiving two votes on the first ballot.
Subsequent Ballots: _ -�� ,
• If two or less candidates obtain two votes, each council member votes for
one.
• If three or more candidates obtain two votes each, council members votes for two.
In this way, we "narrow the field" to determine which candidates have the greatest opportunity to
obtain a majority vote of the Council.

I endorse with enthusiasm the appointment of Kenneth
Schwartz to the San Luis Obispo City Council.
As editor of the Telegram -Tribune for 20 years (1963-1983),
I watched his conduct as a city planning commissioner, a member
of the city council and mayor. His concern for the city and
its citizens was evident as he grappled with such matters as
growth, water, open space and an economically viable downtown
area.
Ken was one of the motivators in the development of Mission
Plaza and continues to work for the expansion of the Plaza and
additional beautification of the city.
Shortly before his death, retired Superior Court Judge
Timothy I. O'Reilly admonished me, as editor to "Take care of
the town". This, I tried to do. I am confident Ken Schwartz,
as a city council member, will continue to do so.

This is to express my hope that you will favorably consider Sally Stoner when you make the decision
concerning a replacement for Kathy Smith.
From my observation, Sally has been an active participant in the life of San Luis Obispo for several years.
She is well respected by those with whom she has worked in various organizations and while holding
positions on city committees. She is deeply committed to the well being of San Luis and would. I believe,
prove to be a thoughtful, creative, and productive member of the City Council. She is well acquainted with
people in many businesses and civic organizations and in the community at large. She would, I feel, serve
as a valuable point of reference with residents of diverse opinions. She appears to me to be someone who
would be independent of special interests and would logically weigh the various alternatives in any given
situation. That, it seems to me, is a valuable attribute for a city council member to have.

I have known Evelyn Delmartini and her husband Charles since I moved to
San Luis Obispo nearly twenty years ago. We were active in the Chamber of
Commerce, La Fiesta and many other civic activities over the years. My
late husband was an attorney who handled. business transactions, and I believe
that we first met through work activities and subsequently became friends.
I was thrilled when Evelyn announced she wished to serve on the City Council..
She has an excellent reputation in the community as a fair, honest and
hardworking individual who has spent a great deal of time and effort
following city issues and promoting policies favorable to working families and
small businesses. Evelyn understands what it's like to try to make a living here
while working in the private sector. we need this kind of perspective on the
City Council. She has lived here a long time and is, I believe, motivated by
a genuine desire to serve rather than any desire .to promote herself.
On a more personal -note, I know Evelyn to be a compassionate individual who
has done -97 -great deal "behind the scenes' to help the less -fortunate in our city.
I am confident that she. would exhibit this same sense of responsibility and
caring for our community in making her decisions;

We have known Sally Stoner for the twenty years she has lived in San Luis Obispo. We
would like to offer our support for her appointment to the seat being vacated by Kathy
Smith on the City Council.
Sally has always been one to "get involved" whether it was at PG&E where she worked
for twenty years or the community in which she resides. This is evidenced by the many
committees and commissions on which she has served. Not only is she motivated to "get
involved" but is also very effective in accomplishing tasks because of her ability to interact
and work with people in resolving critical issues. She does this by listening to all input on
issues and then proceeds with a reasonable "middle of the road" approach.
As natives of San Luis Obispo, we are interested in seeing this community remain the
special place it has always been.

Thank you for the opportunity to submit my application for appointment
to the Council Seat being vacated by Kathy Smith.
For many years I have followed the actions of our City Council and
attended Planning Commission and Council meetings. I feel comfortably
familiar with the current Council members and some members of staff,
having previously served four (4) years on the Promotional Coordinating
Committee.
I have taken an active roll in the leadership and direction of this city,
participating in civic and social organizations as well as in the business
sector where I have been both employer and employee. My community service
at Cal Poly has enlightened me to the needs of, and value of, these and .
Cuesta College students. Some of my affiliations are listed at the end
of this letter.
A native of New York State, I moved here in 1945 and attended local schools.
My husband, Charles, is a County native. We have four grown children and
four grandchildren.
Recently retired, I now have the time to serve my City. I am seeking the
appointment to Council as I feel I would be a.good replacement for Kathy
Smith. Politically I feel I am 'middle of the road' and can work in harmony
with the other Council members_ I have been following the long term issues
of Edna -Islay and Airport annexation, parking garage expansion, sports complex,
open space ordinance, water issues and Prop. 218. I have attended meetings
on the 2 -year Budget setting process and the General Plan Land Use text. Now
would be a good time to put my knowledge to work.
I am looking forward to the interview process on September 8, 1998.

To know San Luis Obispo is to know a place of many communities. The university
presence provides an academic vitality that is unique. Our geographic location
creates a tourist destination of spectacular beauty and hospitality. As the county
seat the city is a place of governance, a dynamic downtown business sector, and
the hub of social services and non-profit agencies that work. collectively to meet
the needs of a growing and diverse population.
The task of the city council is to marshal the energy and the resources that surround
us to continue the legacy of environmental quality and business vitality that
together make San Luis Obispo a very special place.

I am troubled that the 1999F-2000 Council will have little local government experience. For this
reason, I am offering my experience and qualifications for your consideration:
I am a 26 year public forum veteran; I understand the give and take necessary to build
consensus and resolve public issues.
I have served as Mayor of our city for 10 years and City Planning Commissioner for 8 years.
I successfully chaired the Board of Directors of the largest corporation in San Luis Obispo for
10 years; I understand business.
I am a trained architect who has chosen to make my life's work the study and design of cities.

I would like to thank the City Council members for their work in general and on this
application process. This has been an experience both humbling and educational. I am not
sure that the general public is aware of the tremendous amount of time and energy each
member puts into their city council position. Fortunately, you are supported by an excellent
professional staff that keeps the city and the council running smoothly. You have achieved a
balance which has protected our unique city while maintaining positive growth and a healthy
economy.
1 believe that government is strongest when citizens take responsibility and are
involved lin their community.
My past experiences in and outside of the community are varied and give me a diverse
perspective:
As the executive director of San Luis Obispo County Special Olympics
• 1 ran a complex business for almost a decade, keeping a dose watch on the
economy and health of the city. 1 can relate to the concerns of local
businesses.
• I became acutely aware of the need for sports venues for our children. We worked
with and received support from the San Luis Obispo City Parks and Recreation
department.
• We were also supported by and developed a relationship with Police Chief Jim
Gardiner and the San Luis Obispo City Police Department.
• Finally, having built a Special Olympics community of over 500 athletes, their
families, and over 1,000 volunteers, I have extensive experience in consensus
building and mediation.
As a past banker
• I am keenly aware of the need for fiscal responsibility and positive healthy growth.
• I am familiar with financial statements, projected versus actual budgets and am
able to take a cold hard look at the bottom line.
• The business vitality that is exemplified by the Downtown Center is an example of
the approach that can be taken to keep our economy sound.
As a past Cal Poly employee
• 1 value all that the university and Cuesta College contribute to the city and have a
great appreciation for the students attending these schools.
• 1 would like to see these students more Involved in our community. This is an
untapped valuable resource.
As a past Peace Corps Volunteer
• 1 applaud the way the community came together in what was almost an old-
fashioned community bam raising to build a new homeless shelter.
As person who is concerned about the environment, I believe:
• "Once it is developed, once the open space is gone, once the hill is
covered with houses, once the oak trees are cut down, we'll never get it back
again. Each decision for growth must balance what we may lose -- irretrievably.
The natural beauty around us is priceless.
• 1 am pleased that this past council has shared this vision. The acquisition of
Bishop's Peak is testimony to our common concern.
As a volunteer:
• I have worked with a wide variety of agencies in a wide variety of roles.
• My local experiences with The Human Relations Commission, Hospice, The AIDS
Support Network, United Way, Achievement House, March of Dimes, the Arthritis
Foundation, and the San Luis Obispo Arts Council have given me a chance to
Interact with individuals from all backgrounds in our city.
We face many issues. Just a few are:
• Growth and water.
• The preservation of our heritage and our unique beautiful environment.
• The year 2,000 computer challenge.
• The annexation of the county airport.
• The preservation of our neighborhoods.
The City's efforts, such as the restoration of the adobes in town, build upon our heritage and
are truly, truly important. We need to maintain our sense of history. We have designated
districts -- Old Town, Mission Plaza, Railroad, Mill Street, China Town -- that give us a sense
of place and a sense of history that we must sa6eguard not only for ourselves but for future
generations.
One of the strengths I bring is my experience in consensus building. I know how critical it is
for organizations to chart direction that considers the needs of all stakeholders.
1 believe than I bring the necessary skills to maintain -a balance on the City Council.
1. I am accustomed to working successfully on committees with diverse groups of people.
The new council member needs to fit in and be able to worksmoothly with others. My
broad base of experiences has given me an appreciation for divergent opinions.
Z. The City of San Luis Obispo is fortunate to have highly profiessional staff who are
committed to high quality standards of work and response to the public. It is important
to acknowledge the expertise and dedication of these individuals as we go through our
daily deliberations.
3. One of the hallmarks of a caring council is the ability to provide a forum for city residents
who believe that city policies or regulations do not support the community's best
interest. I have personally had the opportunity to take a property concern through the
various levels of the city to the council and believe that this forum is uniquely
quintessential to the American government process.
4. While the city has a major responsibility in deciding growth and land use issues, its
Involvement in smaller issues is also important in affecting the quality of life for San Luis
Obispo. Bike trails, the homeless shelter, the Children's Museum, the concerts at Mission
Plaza, the funding of non-profit agencies all contribute to our enjoyment of the city.
5. While the Performing Arts Center is positive, there is a strong local artistic community
that adds and gives us inspiration and an appreciation for the aesthetic that is very
wonderful. Art in Public Places adds to the delicious flavor of our city.

Good government requires balance and consensus building. While the current
council has been effective and cooperative, it includes no one actively involved in
private business. I would bring this perspective to the Council.
This application is submitted for the same reason I applied for the Planning
Commission - - I believe I possess attributes that will help the City. My real
estate, legal, and mediation background have provided the skills to work
logically and effectively toward sound decisions on complicated and
controversial problems. My colleagues on the Commission electing me chairman
on two occasions and indicating they are pleased with my performance evidence
this.
My wife Ginny and I have balanced the time required to raise four children,
maintain my business, and effectively serve the community. Our last child has
left for college and I am self-employed, giving me time and the flexibility needed
for City Council responsibilities.
Since 1987 I have assisted over 150 local entities from non-profit organizations
and governmental agencies to small and large businesses in locating suitable
facilities. This has provided a varied network and broad understanding of the

I am willing to fill the vacant seat on the council. I do not work
a paying job. My time is my own, which I give first to raising my
teenage son, and then to volunteering in various positions.
This community would be better served by a greater diversity of
opinion on the council than has been apparent in recent times.
There are many folks who feel disenfranchised, who feel their
interests are not being well represented. I will bring a strong
voice for the causes of neighborhoods and the environment.
This will be my 12th year volunteering in our schools, in the
classroom, library, as PTA treasurer and president, School Site
Council member and chair, and occasionally helping to influence
school board policy. I also have given time to organizations such
as AYSO and SLO Citizens for Medical Marijuana, and occasionally
helped out Grass Roots II and the People's Kitchen.
I have served as board member and chair of ECOSLO, spent years
attending public meetings as an educated community advocate on
UNOCAL and neighborhood/social issues, and am now serving on the
county's Water Resources Advisory Committee.

Because I love SLO, I want to serve on the City Council of SLO. My family
has made SLO our home for ten years now, and I hope we stay here. How
do I love thee? Let me count the ways. I love the size, small enough so I can
often meet my friends around town. I love the friends we have made. I love
the fact that I can ride my bike from home to work and to downtown in 15
minutes. I love all the small businesses, making a unique living and working
experience..
I want to help shape the decisions made as the City moves into the
future. I support the principles of a just and sustainable society. Therefore I
oppose the shopping center on the Dalidio farm. I oppose taking water from
a raised dam on Santa Margarita Reservoir. If we increase our population,
then we must conserve water more, and use dual -piping to use more
nonpotable water. Think globally, act locally. Annexation should be done so
benefits, not just costs, accrue to the current City residents.
Because I love politics, I look forward to devoting lots of time to civic

CAO RECOMMENDATION: Direct the City Clerk to advertise for applicants. to fill this
vacancy, and set a public hearing for Tuesday, September 8, 1998 to consider candidates for
appointment.
DISCUSSION
Situation
On July 23, 1998, Vice Mayor Kathy Smith sent a letter to the Mayor and City Council announcing
that she would be resigning from the City Council effective August 31, 1998 (Exhibit "A"). Ms.
Smith was first appointed to fill an unexpired term on December 13, 1994. In November, 1996, she
was elected to a four year term expiring on December 1, 2000.
Background
Section 406 of the City Charter (Exhibit "B") states that when a vacancy occurs, the remaining
Council, by a majority vote, must appoint a replacement member within 30 days of the occurrence of
the vacancy, or, if an appointment cannot be made, ser a date to hold a special election. A special
election must be held not sooner than 90 days or later than 150 days following the occurrence of the
vacancy. In this case, the election could occur no sooner than December 1, 1998, and no later_ than
January 28, 1999.
Section 3.3 of Council Policies & Procedures (Exhibit "C") outlines a specific process for
conducting an appointment to the City Council. The City Clerk must place a legal notice advertising
the vacancy at least 10 days prior to holding a meeting to select a replacement member. The
minimum qualifications for appointment is residency in the City at least 30 days prior to
appointment and elector status at the time of appointment. Each applicant is encouraged to submit a
200 word statement of qualifications stating reasons for wanting the appointment, personal
qualifications, community involvement, prior experience in government or associated areas, and the
amount of time he/she has available each week to devote to Council. Resumes may be submitted
with the statement if the applicant desires.
It is recommended that Council set the date of Tuesday, September 8, 1998 to hold a meeting to
consider the selection of applicants. Individuals may submit written statements of qualifications to
the City Clerk between 8:00 a.m., Monday, August 24 and Friday, August 28, 1998 at 5:00 p.m.
These statements would be made available to the Council and public on Monday, August.31, 1998.

Members of the public may also submit written comments at any time before the meeting.
During the September 8 meeting, each applicant wishing to serve will be given five minutes to make
a presentation to Council and will be asked to verify their willingness to serve. After all speakers
have concluded, the Mayor will return discussion to the Council for further consideration. Each
Council Member will be given a transparency with the names of all the applicants and asked to circle
their top choices. These transparencies will then be put on the overhead in full public view while the
City Clerk tallies the results. The names of those who receive at least three votes will then be put
into nomination. This process was successfully employed when filling the Council vacancy in
December, 1994, resulting in the unanimous appointment of Kathy Smith.
If no person is appointed, the Council may continue this item from time to time in an attempt to
reach a decision no later than September 30, 1998, 30 days following Ms. Smith's resignation. If the
Council fails to make an appointment by that date, a special election must be called.
CONCURRENCES
The City Administrative Officer and City Attorney both concur with this recommendation.
FISCAL IMPACT
If the Council makes an appointment to fill this vacancy, the fiscal impact would be minimal.
However, a special election, whether conducted for the City by the County Elections Division or an
election contractor, is estimated to cost from $65,000 to $75,000.

It is with mixed emotions that I submit my resignation as Vice Mayor/Council. Member
for the City of San Luis Obispo, effective August 31, 1998.
As noted in an attachment, I have accepted an opportunity to become Executive Director
for The Literacy Initiative, an umbrella non-profit working with 30 Literacy programs in
the Columbus, Ohio area.
It has been a great honor to serve on this San Luis Obispo City Council I know we have
set a new tone for respect for individual differences as well as a commitment to respect
City Staff and any resident who chooses to express opinions in Council Chambers. I am
sincerely proud to have served with such professional, elected officials.
Our fivesome has done much to enhance the "quality of life" .in SLO. In addition to
investing in landmark Open Space purchases, we have laid groundwork for the Airport
Area Annexation, long-term water resources and significant efforts such as the
Neighborhood Enhancement Ordinance, Prado Day Center and Community Development
Block Grant.Funding for the Aids Support Network.
I am particularly proud of the creation of the Economic Development and Natural
Resource manager programs, the revitalization of Public Art projects; Chinese and
Railroad historic preservation initiatives, the `recycled" Angels' seats now at Sinsheimer
Stadium and our 'thoughtful decisions on industrial, residential and commercial
development projects.
It is difficult to exit. I feel I have been a bridge builder and have added balance and
objectivity in decision-making. I will miss the challenges of Council, working with such
a competent City staff and — most of all — each person individually.

SECTION 405. Limitation of Terms.
Neither the Mayor nor any member of the Council shall serve in the same office for more than
eight (8) years in succession; provided, however, that any time in office resulting from a partial term
which is less than one-half (1/2) the length of the full term for that office, shall not be considered.
(Amended November 5,1985 —Measure "C".)
SECTION 406. Vacancies.
An elective office becomes vacant when the incumbent thereof dies, resigns, is removed from
office under recall proceedings, is adjudged insane, convicted of a felony, or of an offense involving a
violation of the Mayor or Councilmember's official duties; or ceases to be a resident of the City, or has
been absent from the State without leave granted by the City Council for more than sixty (60)
consecutive days, or fails to attendthe meetings of the Council for a like period without being excused
therefrom by said body.
A vacancy in the Council shall be filled for the remainder of the unexpired term, if any, at the
next regular municipal election following not less than seventy-two (72) days upon the occurrence of
the vacancy, but the Council by a majority vote of its remaining members shall appoint a qualified
person to fill the vacancy until the person elected to serve the remainder of the unexpired term or new
term takes office. If the term still has two (2) years until expiration at the time of the next regular
municipal election, the election to that seat shall beseparated from the election for the other Council
candidates. If the Council fails to fill the vacancy within thirty (30) days following its occurrence, it
shall call a special municipal election to fill the vacancy, to be held not sooner than ninety (90) days or
not later than one hundred and fifty (150) days following the occurrence of the vacancy. The election
shall be governed by the provisions of Article M.
A person elected to fill a Council vacancy for an unexpired term shall take office on the first
Tuesday following his election. Notwithstanding any other provisions of this Charter, a minority of the
members of the Council may fill vacancies on the Council by appointment in the event that a majority
of the Council seats becomes vacant. (Amended November 5, 1996 - Measure "T.)

3.2 APPOINTMENT OF VICE -MAYOR
The appointment of the Vice -Mayor shall be for a one-year term and is made on a rotational basis,
the appointment going to the next senior member. The Vice Mayor shall be appointed at the first
meeting in December. (Motion adopted 12/19/83 and 12/02/85.)
33 FILLING COUNCIL VACANCIES
33.1 APPOINTMENT OR SPECIAL ELECTION
Per City Charter Section 406, the Council shall by a majority vote of the remaining Council
members, appoint a replacement member to the Council within 30 days of the occurrence of
the vacancy. If the council fails to fill the vacancy within thirty (30) days of its occurrence, it
shall call a special municipal election to fill the vacancy, to be held not sooner than ninety (90)
days or not later than one hundred and fifty (150) days following the occurrence of the
vacancy.

33.2 PUBLIC APPOINTMENT
In order that the public may know how its business is being conducted, all phases of the
Council process to appoint a replacement member to a vacancy shall be conducted in public.
3.3.3 ADVERTISE FOR APPLICANTS
At least ten days before Council meets the first time to select a replacement member for a
vacancy, the City shall advertise in a local newspaper of general circulation describing the
vacancy and term thereof, requesting applications from those persons interested in being
appointed.
33.4 QUALIFICATIONS
Although the only two established minimum qualifications for appointment are (1) residency
in the City for at least 30 days prior to appointment, and (2) elector status at the time of
appointment (City Charter § 403), each applicant shall be encouraged to submit written
statement of 200 words or less covering at least the following areas: (Res. 8377

3.3.5.1 At a time(s) selected by the Council, a meeting open to the public shall be
held by the Council to consider the selection of an applicant to fill the
vacancy.
3.3.5.2. The applications shall be given to the Council and be available to the
public at least four days before the opening of the meeting.
3.3.5.3 Members of the public may submit written comments regarding an
application at any time up to 24 hours before the meeting begins.

3.3.5.4 At the meeting each applicant wishing to serve should be present to verify
that they would be willing to serve, if appointed, and that they are
residents of the City: Each candidate will be given five minutes to make a

3.3.5.5 Thereafter, all discussion shall be confined to the Council except for
questions directed by the Council to staff or to members of the public.
3.3.5.6 Upon the conclusion of such discussion, the Mayor shall open the floor to
nominations by the remaining Council Members. All nominations,
seconding, and voting; shall be done audibly in public.
3.3.5.7 If no person is appointed, the Council may adjourn the meeting from time
to time to attempt to reach a decision at any time within 30 days of the
occurrence of the vacancy: (Res. 4423)
3.4 GENERAL POWERS OF THE COUNCIL
Subject to the provisions and restrictions contained in this Charter and the delegation of power, if
any, to any person, officer, Board, or Commission, the Council shall have the power in the name of
the City, to do and perform all acts and things appropriate to a municipal corporation and the
general welfare of its inhabitants and which are not'specifically forbidden by the Constitution and
laws of the State of California, or which now or hereafter would be competent for this Charter to
specifically enumerate.
No enumeration or specific statement herein of any particular powers shall be held to be exclusive
of, or a limitation of, the foregoing general grant of powers. (Charter Section 50I )
3.5 ADMINISTERING OATHS: SUBPOENAS
Each member of the Council shall have the. power to administer oaths and affirmations in any
investigation or proceeding pending before the Council. The Council shall have the power and
authority to compel the attendance of witnesses, to examine them under oath and :compel the
production of evidence before it. Subpoenas may be issued in the name of the City and be attested
by the City Clerk. Disobedience of such subpoena or the refusal to testify (upon other than
constitutional grounds), shall be deemed contempt and shall be punishable as provided by the
general laws of the State. (Charter § 507)
3.6 LEMTATIONS
No member of the Council shall be appointed to or serve as a voting member of any City
Board, Committee, or Authority, whether composed of citizen volunteers, City employees, or a
combination of both. This is not to be construed as prohibiting members of the Council from
serving on Committees or Subcommittees of the Council itself, or of agencies representing other

It was with considerable regret that I learned of the impending resignation of Councilwoman
Kathy Smith. I have been proud of this City Council and your contributions both individually and
collectively in woridag for the betterment of our City.
Kathy's resignation creates a problem which I find very troubling. Unless Kathy's seat is filled
with someone exy =—..-d in cky operations, the 1999 - 2001 Council will likely have but two

Each of you knows that I have maintained a deep rooted interestin our city and its governance.
have tried to keep abreast of current problems andconditions and I have made suggestions and
contributions when I felt I had something positive to say. I have had 26 years of direct hands-on
land planning experience recently completing an eight year stint on the County Planning
Commission. I served on the'81= 82 Grand Jury that -finally nudged the County Board of
Supervisors into updating the County's Master Plan for Water. Obtaining a reliable supplemental
water source for our city is of critical importance; I am familiar with the condition of water
resources of our city as well as our county. Our downtown is especially dear to me:
