Date: September 5, 2016 From: Allan Cooper, Secretary Save Our Downtown Honorable Mayor and Council Members I would like to echo concerns that have already been submitted to you by Sandra Rowley, Chairperson of Residents For Quality Neighborhoods, in her September 4, 2016 letter. We are both asking you to add an additional task to the consultant's proposed Zoning Regulation Update Work Scope. This request could be included not only in the City's ongoing effort to address LUE Program 2.13 "Neighborhood Compatibility" but, more importantly, it could be addressed by re -including the omitted LUE Program 2.14 "Neighborhood Wellness Action Plans" which would "help devise strategies to maintain neighborhood character, safety and stability." On behalf of all R-1, R-2 and R-3 neighborhoods where only a creek separates these neighborhoods from Tourist Commercial, Downtown Commercial, Retail Commercial, Community Commercial and Office Zones, we are requesting that the City place a Special Consideration Overlay onto the following C -T, C -D, C-R, C -C and O zones identified below. This precedent has already been established for the C -T S zone abutting the San Luis Drive neighborhood. Dana Street Neighborhood Just as Ordinance 1130 Special Consideration Overlay applies to the C -T zone encompassing the Monterey St. motel district flanking San Luis Obispo Creek and the R-1 zoned San Luis Drive, so should Ordinance 1130 Special Consideration Overlay apply to the C -D and C-R zones encompassing the Higuera St. commercial district flanking San Luis Obispo Creek and the R-3 H zoned Dana Street neighborhood. However, the sake of consistency and fairness, I am suggesting (and this goes beyond Sandra Rowley's recommendation) that we should also apply this same line of reasoning to similar situations north of Highway 101 and south of Marsh Street. Lincoln Street Neighborhood Ordinance 1130 should also apply to the O and C -T zones encompassing the Olive St. motel district and the Chorro/Santa Rosa St. office districts flanking Brizzolara Creek and the R-1 zoned Lincoln Street neighborhood. Pismo Street Neighborhood One other example where this situation applies, though only for a very small area, is the C -C and O zones encompassing the Marsh St./Johnson Ave. neighborhood shopping and professional office districts flanking San Luis Obispo Creek and the R-2 zoned Pismo Street neighborhood. The purpose and application of the S zone (see below for the full text), and where this application applies specifically to the three neighborhoods identified above, is to assure compatibility of the use with its surroundings, resolve problems such as noise exposure and flood hazard and protect areas of scenic or ecological sensitivity, wildlife habitat. Allan Cooper, San Luis Obispo Chapter 17.56.010 Purpose And Application Of The S Zone "In combination with any zone, to require approval of an administrative use permit before any use may be established. The use permit requirement is intended to assure compatibility of the use with its surroundings or conformance with the general plan, or to determine if a proposed development solves problems such as noise exposure, flood hazard, airport hazard, or slope instability which are particularly severe on a given site. Such development review may also be used to protect areas of scenic or ecological sensitivity, wildlife habitat, or wildland fire hazard."
