Council,
First off, congratulations to Mayor Harmon and Councilmembers Pease and Gomez.
On Tuesday, you will be asked to agree to a settlement with the POA regarding the PERB lawsuit having to do with the
legality of Measure B. Measure B was the charter initiative which repealed binding arbitration for SLO City public safety
employees. Measure B received the support of 73% of City voters in August 2011.
It is extremely disturbing that there is nothing in the publically available Council packet which provides the specific terms
of the proposed settlement. The one-page packet memo says it involves amending Resolution 6620, which has to do with
the City's personnel policies. In what way? All we are told is that "Details of the negotiated settlement and the associated
documents (still being finalized) will be issued under separate cover."
I see that this lawsuit is on the closed session agenda before the public session. Are Council members the only ones who
are going to learn the proposed details in advance?
Given the importance of this matter, particularly since it involved an overwhelming vote of City residents, I urge you to
postpone approval of the negotiated settlement until the details can be publicized in advance and interested parties have
adequate time to review the details.
