THIS IS A PUBLIC SAFETY ISSUE for all, including the students. 2. NOISE: ASI Resolution attempts to minimize "noise" as a mere disturbance. As seen on the daily online police log, noise from parties/events is frequently an indicator of other crimes such as assaults (including sexual assaults), vandalism resulting in property damage to vehicles and homes, threatening residents for calling the police, attempts to enter neighbors' homes, and thefts and burglaries. There is also rampant alcohol and drug use at many of these parties/events that are very harmful to students (see attached letter from ER Dr. Rushdi Cader). If you stop the noise, there is a chance that some of these other crimes and physical harm can be prevented. The reason these particular Safety Enhancement Zone time periods have been chosen is because the party behavior during those periods is more aggregious than at other times. 3. Greeks have been the largest violators of large parties which is why Cal Poly has placed them on probation or suspension several times (see attached Cal Coast News articles). ASI blames those suspensions for the St. Fratty's day roof collapse in 2015 (see Page 3 of Resolution highlighted in yellow). 4. The resolution threatens that if a compromise isn't reached with ASI, the city runs the risk of danger to the community—a veiled threat that there will be large "uncontrolled events" as retribution to the city for expanding the Safety Enhancement Zone period (see Page 3 of Resolution highlighted in blue). S. ASI wants the city to trust them but what specifically have they done in the past to curb event/party noise? To our knowledge, there is no program or procedure that ASI has implemented to curb noise. Noise reductions have occurred due to increased fines, the addition of the Unruly Gathering Ordinance, and Landlord Citations. There has also already been a great deal of education and outreach efforts by Cal Poly and the City in an attempt to curb the parties/events noise. So what is ASI proposing to do now? Do they have a proposed plan or program? 6. What is ASI's definition of a "controlled event"? 7. Is ASI willing to take responsibility if the safety zone period is not broadened and their "controlled" events result in damage to persons or property? Do they have liability insurance? 8. The ASI students who signed this Resolution will be graduating in 6 months. Then what? 9. Many residents believe students have had a chance to be responsible but they have chosen not to do so and large events/parties continue to occur (see large parties attachment for 2015 & 2016). 10. Student events create noise that causes residents to lose sleep and oftentimes fear for their safety. This is the most often stated reason that permanent residents in student impacted neighborhoods decide to move from their long-time residences. The alcohol culture amongst young people here in slo has become so overwhelmingly destructive to lives and property that the leadership of our community has an obligation to do something about it. Over the last 15 years in this community, myself and my colleagues in the ER have literally cared for 1009s of Cal Poly students who have either harmed themselves, others or property due to drug use or excessive alcohol intoxication. It is not uncommon for these students to have alcohol levels to be many times the legal limit ranging from 200 to 450 mg/dl. Many of these youth have been either the victim or perpetrator of physical or sexual assault. Their injuries have ranged from cuts and scrapes to lifelong devastating neurologic deficits or disfiguring facial injuries. The vast majority are incapacitated putting them at risk for becoming the victims of sexual predators or acts of violence. Nowadays drug use is so rampant at Cal Poly that young people feel it to be the norm. 90+% of underage Cal Poly students engage in alcohol use, with a large percentage of those who drink to excess. These young people feel no remorse or sense of shame in using meth, cocaine or marijuana. Prescription drug abuse, like hydrocodone, "xanybombs" (Xanax), and oxycodone is also commonplace. As a community we have failed to channel our youth towards positive behaviors and instead relegated this responsibility to their peers who provide them destructive examples. Our lack of response is saying to the educated future backbone of our society that it's okay to break the law and that there are minimal consequences to such behavior. The parents of these young people sent their children to our community to become educated, not to graduate as alcoholics and drug addicts. I believe there is an answer to curring the problem and it lies in supporting SLOPD, Sheriffs, and CalPoly PD for increased enforcement, and EXPONENTIALLY increasing fines and penalties for publically intoxicated students, underage drinkers, drug peddlers, those who sell alcohol to minors, those who cause injury and property damage while inebriated, and for intoxicated drivers. If being drunk in public costs someone $2500. They are far less likely to repeat the offense. Likewise if being an underage drinker increases that rine by $1500, I believe we will start to see a downslide in the problem. In turn the revenue from such enforcement should be channeled towards treatment programs and covering the cost of having more officers on the street. We are a community with a far worse alcohol and drug problem than any similar sized community in the country. People say that we don't want to become the next Isla vista. 1 believe we are worse. Years ago during the last Poly Royale, I took care of 23 patients with lacerations on that night alone. The injuries were all related to alcohol intoxication or assaults by someone who was under the influence of drugs and 1 alcohol. one was a young woman who lacerated off half of her tongue, another was a man who had deep facial lacerations, lost part of his nose and required almost 75 stitches in his face. Our staff has been assaulted by some of these these students while attempting to care for them (including myself}. They swear and are abusive to staff, which horrifies children who are in the ER for other serious conditions. Some urinate and defecate on themselves and on the floor due to their inebriated state. Lastly the cost of housing 4-5-4- inebriated cal poly kids at Sierra vista every weekend night as they metabolize off their alcohol is more than just the use of a resource and money out of the pocket of patients, parents and insurance companies. It means that while little Johnny is fighting and verbally abusing one of my nurses, that is one less staff person to attend to the child with the broken arm in the waiting room, or the pregnant woman with vaginal bleeding, or even to discharge or admit patients with conditions that they didn't cause themselves. There is a cost to the inaction of enforcement and politicians, and it is in the reduction of the efficiency of the medical services that we in ER's at both Sierra and Twin provide to the rest of our community. Again please consider my feedback as each of you considers how we solve this problem that has clearly spiraled out of control. California Polytechnic State University San Luis Obispo Resolution #17-02 RESOLUTION TO REMOVE NOISE CONTROL FROM PROPOSED SAFETY ENHANCEMENT ZONE AMENDMENT WHEREAS: The ASI Board of Directors serves as the official voice of over 20,000 students at Cal Poly San Luis Obispo, and WHEREAS: For the remainder of this document, the event commonly known as "St. Fratty's Day" shall be referred to as "St. Patrick's Day Celebrations", because it has been an event facilitated and attended by a variety of individuals with and without Greek affiliation, and WHEREAS: The "St. Patrick's Day Celebrations" incident of 2015 was a culmination of offenses outlined in San Luis Obispo Municipal Code 9.22.020, which states: A.Any violation of designated sections of the San Luis Obispo Municipal Code that is committed within an area that has been designated by the city council as a safety enhancement zone, and during the time that designation is effective, shall be subject to a fine that is twice the amount of the fine specified for the designated municipal code sections, up to a maximum of one thousand dollars. B. Safety Enhancement Zone Violations. Fines for violations committed in the safety enhancement zone shall apply to the following provisions: Chapter 9.041 (possession of open containers or consumption of alcoholic beverages in public places), Chapter 9.052 (hosting a gathering where underage persons consume alcohol), Chapter 9.123 (noise control), Chapter 9.134 (unruly gatherings), Chapter 9.166 (dangerous and deadly weapons), and Chapter 9.205 (urination in public). A separate offense shall be deemed to have been committed whenever a person repeats the act that constitutes the violation. We already have a warning system: SNAP as well as DAC's from police officers 4. To our knowledge, schools which have adopted party registration previously had no such warning system. Meetings have included the Cal Poly Inter Fraternal Council, Panhellenic, Associated Students Inc.(ASI) representatives, the Student Community Liaison Committee (SCLC), the Downtown Association's Food, Beverage & Set -vice Committee and a presentation was made at a neighborhood community forum in October which included a number of citizens and community representatives. Generally, outreach identified some key themes that created consternation about the passage of this ordinance as written, to include: • The Safety Enhancement period covering 3/4 quarters of the month of March is excessive and too restrictive. • Increased fines, coupled with fines imposed by landlords, is too punitive and targeted toward a college age population, many of which have other financial constraints and obligations. • The City needs to engage in other areas of collaboration to establish boundaries and not solely rely of fines or other forms of punishment to restrict behavior. • The City will continue to absorb additional costs to staff the 21+ day period should the ordinance pass. These funds should be utilized in other productive ways to reduce crime. • The City needs to become engaged with students prior to writing any ordinance that impacts their demographic in order to obtain true feedback and perspective amongst the entire San Luis Obispo community. • Noise Violations should be excluded from the Safety Enhancement amendments. Excluding noise violations would not diminish the effectiveness of the attended plans purpose. ENVIRONMENTAL REVIEW Amendment of the City's Safety Enhancement Zone is not a project under the California Environmental Quality Act (CEQA), and enforcement actions are categorically exempt pursuant to CEQA Guidelines section 15321(b). FISCAL IMPACT In general, revenue resulting from violations does not cover the costs of providing law enforcement services nor can the City create a scheme by which the revenue from fines pay for specific services. No new enforcement resources are being added to support the additional safety enhancement period. The proposed ordinance expands the time period for existing safety enhancement zone designations. It is unknown the amount of revenue that may be generated from safety enhancement zone violations since it is not yet known to what extent violations will increase or decrease. However, changes that result in increased fines are not likely to generate significant revenue to offset the existing enforcement costs. Staffing costs for this time period would be consistent with the costs during the 2016 St. Patrick's Day deployments. Those cost were estimated to be $3.1,000. Packet Pg. 243 14 2015, the university hired an external investigator, Mr. Ralph Latino. Mr. Latino has had extensive experience as an administrator in the CSU system. In addition, he has served in an interim role directing the Office of Student Rights and Responsibilities at Cal Poly. From April 27-29, 2015, the external investigator conducted interviews with students identified from the preliminary investigation. Findings On Thursday, April 30, 2015, the external investigator provided his findings to OSRR for review. The key findings confirmed earlier information. The facts were as follows: • Students indicated that the marketing for the party was via text/word-of-mouth and that they couldn't identify specific individuals or organizations that were hosting/organizing/marketing the event. • The interviewed students reported that they collaborated to determine a specific date for the event, specifically to avoid double fines. • Because many social media platforms are public and anonymous, as soon as there was enough "word of mouth," and it was confirmed that the event was occurring on Saturday, March 7, 2015, many social media outlets "went viral" with information and ideas on what to do to celebrate the event (pre -game) and where to attend the event (Hathaway). + Many students engaged in pre -gaming. Pre -gaming means to drink alcohol prior to attending a social gathering, usually with close friends, with the intent to become intoxicated. ■ Students reported that this event as a "tradition" had an influence on how the event rose to the level of involving thousands of students. • While some members of Greek organizations helped rally groups of Greeks and non - Greeks, from the residence halls, surrounding areas, and so forth, there is no evidence that a specific Greek affiliated chapter or Greek leadership played a role in facilitating the event and the gathering. + Sitting, standing on, and hanging out on roofs (Brewfing) has been a frequent occurrence for the last few years. Very few students realized that there was any danger because it is such a common practice. The city council may by ordinance, or by resolution upon a finding that there is a need to take immediate action to protect the public health, safety and welfare, designate a specific geographical area as a "safety enhancement zone' and specify the date and/or time that the designation is effective upon a finding that the geographical area is subject to unique conditions and circumstances during a specific period of time that create the potential for a significant threat to public health and safety and that the threat would be reduced by enhanced penalties for violations of provisions of the San Luis Obispo Municipal Code. The ordinance or resolution establishing a safety enhancement zone shall contain the following provisions: A. A description of the geographical area comprising the safety enhancement zone; and B. The date and time, or other specific description of the time period during which the safety enhancement zone designation is applicable to the geographical area (Ord. 1469 § 1 (part), 2004) 9.22.020 Safety enhancement zone penalties and violations. A. Any violation of designated sections of the San Luis Obispo Municipal Code that is committed within an area that has been designated by the city council as a safety enhancement zone, and during the time that designation is effective, shall be subject to a fine that is twice the amount of the fine specified for the designated municipal code sections, up to a maximum of one thousand dollars. B Safety Enhancement Zone Violations Fines for violations committed in the safety enhancement zone shall apply to the following provisions: Chapter 9,04 (possession of open containers or consumption of alcoholic beverages in public places), Chapter 9_,05 (hosting a gathering where underage persons consume alcohol), Chapter 9.12 (noise control), Chapter 9..13 (unruly gatherings), Chapter 9:16 (dangerous and deadly weapons), and Chapter 9.,_20 (urination in public) A separate offense shall be deemed to have been committed whenever a person repeats the act that constitutes the violation. A The entire area within the city limits of San Luis Obispo is designated a safety enhancement zone during the Mardi Gras period, effective from 12:01 a m on the Thursday preceding "Fat Tuesday" until seven a m. on the Wednesday following "Fat Tuesday." B The entire area within the city limits of San Luis Obispo is designated a safety enhancement zone from 12:01 a.m. on March 17th (St. Patrick's Day) until seven a.m on March 18th of each year C The entire area within the city limits of San Luis Obispo is designated a safety enhancement zone from 12:01 a m. on October 31st (Halloween) until seven a m. on November 1st of each year. SHARE A. In order to control unnecessary disturbances caused by unruly gatherings in the city, it is declared to be the policy of the city to prohibit unruly gatherings that create a substantial disturbance of the quiet enjoyment of private or public property in a significant segment of a neighborhood as specified in this chapter. B. It is determined that unruly gatherings are detrimental to the public health, welfare and safety, and are contrary to the public interest. "Gathering" means a group of persons who have assembled or are assembling for a party or social event, occasion or activity on private property. B. "Responsible person" means and includes, but is not limited to: (1) the person who owns, rents, leases, or otherwise has legal control of the property where the gathering takes place; or (2) the person who caused the gathering to occur. C. "Juvenile" means and includes any person under the age of eighteen. D. "Minor" means and includes any person at least eighteen years old but under the age of twenty-one. E. "Unruly gathering" shall mean a gathering of twenty or more persons on private property that results in conduct that causes a substantial disturbance of the uiet en'o ment of private or public ro ert in a -significant segment of an immediate nei hborhood or resents a threat to the health welfare and safet of those in attendance, responding enforcement ersonnel, or neap residents or pro e�rtieA.
