It is puzzling, therefore, that this Draft Report has not been included in your packet to allow a more meaningful analysis of these guidelines under CEQA. Nevertheless, I wish to inform you that you may be in violation of CEQA law by reviewing this project at this point in time. Your "final review" of these guidelines constitutes project approval without first completing CEQA review. After considering the final EIR and in conjunction with making findings under 14 CCR Section 15091, the lead agency may decide whether or how to approve or carry out the project. If the final EIR is found inadequate... and at this point it is still in draft form and therefore clearly inadequate, no action may be taken on the project. Thank you!
