Please refer to the suggestion made by staff in the last paragraph on Packet Pg 154 after discussion with the real estate community the problems that may be associated with a replacement vs. inspection only. Some of the concerns that I have with the requirement of the lateral replacement is due to the inability to get a replacement done in time to coordinate and finish the replacement within a 15 to 20 day escrow. You have lender loan locks that could expire and it would cost someone money to extend that lock and in most cases a Buyer needs to remove their contingencies for inspections within the first 17 days from acceptance. How fast can an inspection be done, then how long does it take to get a permit and then how long does it take to complete. This could be a real burden for the senior community and others on a fixed income. There was an estimated cost to inspect of $250.00 plus an estimated cost to replace of $8,000.00 I would encourage the rebate program and I would ask you to consider increasing the rebate "up to" $2,000.00. Put some incentive behind this and you may get volunteer inspections and replacement. Point of sale ordinances have proven to be a very slow way to complete a requirement within an ordinance. As most of our housing is older I appreciate the exception to the ordinance for those homes that were built in the last 20 years or have had an inspection done recently. Although we as the Realtor community are grateful that you reached out to us as a stakeholder, I think its unfortunate that reaching out to other stakeholders such as homeowners and the community at large will happen after your consideration and possible adoption of this ordinance. If I understand this correctly, you need to have this as an item on the council agenda for "consideration" on the 16th as part of the settlement(?) but you do not necessarily need to a adopt it that night, correct ? If adoption is not required, please give consideration to the possible adoption at some point in the future after there is more community involvement including more discussion with the real estate community. I believe there is more to this and more information may be needed to make a decision. As always, thank you for time and consideration Steve Delmartini
