SUBJECT: May 16, 2017 Agenda Item #9 - Private Sewer Lateral Ordinance for Inflow and
Infiltration Reduction
Staff has received a request from a Councilmember for the following information regarding the
private sewer lateral ordinance that will be brought before Council on May 16, 2017.
Question/Comment
1) In terms of point of sale, do we have a mechanism to require upgrades after close of
escrow but within a timeframe, e.g., 6 months after close of escrow?
Staff Response: Yes, there are a variety of ways we could require the upgrades after the
close of escrow. Presently, the ordinance requires the repair or replacement before close
of escrow. If this is not accomplished, the City would be required to enforce the
ordinance which begins with a time -frame to achieve compliance. The alternative
presented in the staff report requires just disclosure of the inspection report and no time-
frame for repair/replacement.
2) Is there a standard for rating the condition of a lateral, or will any damage trigger
replacement?
Staff Response: There are a few standards for rating, they are complicated and not
specific for evaluating I/I. Prior to the ordinance becoming effective, staff will work with
plumbers and home inspectors on how to apply the performance standards listed in
13.08.395 (B3). Reasonable discretion will be exercised to allow a repair if that would
bring the lateral into compliance with the ordinance. We will be working with plumbers
and home inspectors on the consistent application of the inspection and ownership,
maintenance and repair requirements.
3) Exception 2b on page of 160 of the agenda packet seems to have left off the timeframe, S
years I think.
Staff Response: 5 years is the correct timeframe and will note the change during
tonight's hearing.

4) For inspection requirements listed on page 161, is it reasonable to add a requirement
that the inspection include confirmation that there is no prohibited inflow from roof
drains, etc. (section 13.08.030.A?)?
Staff Response: We placed that requirement in the private sewer lateral inspection form
found on page 162, where it references 13.08.395.B. which covers 13.08.030.A.
13.08.030 is an existing section in the sewer ordinance.
S) Other than time of sale, is there a time frame for repair or replacement (bottom of page
162) ?
Staff Response: The City may condition a planning or building application to replace or
repair a lateral prior issuance of a permit. The City may also require the repair or
replacement of a lateral if found out of compliance with the ordinance. In this process, we
determine a time frame to complete the work needed to bring the lateral into compliance.
This is rare and typically an enforcement action connected with some other violation,
such as a wastewater spill.
Based on Council input from the April 4, 2017 study session, staff will be returning
sometime next year with a study session to explore a possible accelerated lateral program
that could establish addition criteria and different time -frames for inspection, repair or
placement.
