I urge you to carefully review and reconsider the language as
presently proposed and to direct staff to research and revise prior to
final adoption.
The justification for the 17.94.100 is that a development agreement
has no environmental impact, any project will be subject to CEQA.
"D" then switches the findings from the agreement to the project.
You are asking the Planning Commission to find that a project
complies with CEQA prior to any environmental review. Any such
finding will not be supportable thereby leaving the City open to
litigation, and failing to accomplish the goal of this section.
In reconsidering the ordinance please also note that "B" is too
vague. The "other applicable ordinances and regulations" need to
be specified or that language deleted.
