Subject:City Council 10/17/17 Item # 10-Cerro San Luis CEQA & MND
Hi Bob,
When I saw you at City Hall last week you stated the Cerro San Luis night biking/ hiking evaluation
reports would become available on the City's website late in the afternoon of October 10th. I was
disappointed to see in the staff report that the MND was filed with the County on Sept. 15, 2017.
I am signed up to receive all notifications from the City and was not notified by the City of this
important document's existence. Since there should be a 30 day window to comment on the MND it
looks like handling of the document was not shared consistent with our City's committment to open
government.
The City is ethically obligated to allow the residents 30 days from the date the MND was disclosed to
the public to allow the filing of written comments. Since the filing with the County was unknown to the
public and notification was not made by the City to those who asked to be notified of such issues
this would mandate that the City accept written comments from the public until November 9, 2017
and time for the City to respond prior to the City Council taking action.
The matter is premature and Item 10 of the October 17, 2017 City Council Agenda needs to be
postponed to a later date so that proper CEQA process has time to run its course. There are many
items that were not adequately addressed in the MND and some were not addressed at all.
