— 30-day public review period for MNDs
— Pilot Program for Extended Winter Open Space Hours of Use
— Laguna Lake Dredging and Sediment Management Project
City Council has received correspondence from a member of the public regarding the Pilot
Program for Extended Winter Hours of Use that raises concerns about the City's adherence to the
30-day public review period that is required by the California Environmental Quality Act(CEQA)
prior to adoption of a Mitigated Negative Declaration(MND). CEQA Guidelines sections 15070-
15075 and 15105 outline numerous legally-required procedural steps for noticing and adoption of
a MND.
Upon review, pursuant to the concerns raised, staff has determined that the legal advertisement
that was published in the San Luis Obispo Tribune on September 23, 2017 did not meet the full
30-day public review period requirement under section 15072(b)(1). Staff is recommending that
this item be heard on October 17th, but that the item be continued and the public comment period
extended to October 24th allowing for the Council to take final action at its scheduled hearing on
October 24tn
Council should also be aware that the Mitigated Negative Declaration for the Laguna Lake
Dredging and Sediment Management Project is effected by the same procedural noticing issue,
and thus we recommend that the public comment period also be extended and this item be
continued to October 24th before taking final action.
