HomeMy WebLinkAboutResolution105442014SeriesSRESOLUTION NO 1044 (2014 Series) A RESOLUTION OF THE CITY COUNCIL OF TiIE CITY OF SAN LUIS OBISPO, CALIFORNIA, 11ROVIlliNG FOR TiiE FILING OF REBUTTAL ARGUMENTS FOR CITY NIEASURES SUBMITTED AT MUNICIPAL ELECTIONS WHEREAS, a General Municipal Election is to be held in the City of San Luis Obispo California on November 4 2014 at which time there will be submitted to the voters the following measure To protect and maintain essential services and facilities — such as open space preservation bile lanes and sidewalks public safety Yes neighborhood street paving and code enforcement flood piotection senior programs and other vital services and capital improvement projects — shall the City s Municipal Code be amended to extend the current one-half percent local sales tai lot eight years with No independent annual audits public goal -setting and budgeting and a Citizens Oversight Commission? WHEREAS, Section 9285 of the Elections Code of the State of California authorizes the City Council by majority vote to adopt piovisions to provide for the filing of rebuttal arguments foi City measures submitted at municipal elections NOW, THEREFORE, The Citv Council of the Citv of San Luis Obispo California does resolve declare determine and ordei as follows SECTION 1 That puistiant to Sections 9285 of the Elections Code of the State of California when the Elections Official has selected the arguments for and a{oamst the measure which will be printed and distributed to the voters the Elections Official shall send copies of the argument in favor of the measure to the authors of the argument against and copies of the argument against to the authors of the argument in favor immediately upon receiving the arguments The author or a majorit), of the authors of an argument related to a Citv measure may prepare and submit a iebuttal argument not e\ceedino 250 words or may authorize in writing anv other person or persons to prepare submit or sign the rebuttal argument A rebuttal argument may not be signed by more than live authors In case an,,, argument is signed by more than five authors the signatures of the first five shall be printed The rebuttal arguments shall be filed with the City Clerk signed with the printed name(s) and signature(s) of the author(s) submitting it or if submitted on behalf of an organization the name of the organization and the printed name and signature of at least one of its principal officers not more than 10 days after the final date for filing direct arguments The R 10544 Resolution No 10544 (2014 Series) Page 2 rebuttal arguments shall be accompanied by a Corm of Statement to be Filed by Authors of Argument Rebuttal arguments shall be printed in the same manner as the direct aig.umcnts Each rebuttal argument shall immediately follow the direct argument which it seeks to rebut SECTION 2 that all previous resolutions providing for the filing of rebuttal arguments for city measures are repealed SECTIOiV 3 That the provisions of Section I shall apply at the next ensuing: municipal election and at each municipal election alter that time SECTION 4 That the City Clerk shall certily to the passage and adoption of this Resolution and enter it into the boot: of original Resolutions On motion of Council Member Ashbaugh seconded by Vice Mayor Christianson and on the followina roll call vote AYES Council Members Ashbaugh and Smith Vice iIMavor Christianson and Mayor Mar\ NOES Council Member Carpenter ABSENT None The foregoing resolution was adopted this I" day of July 2014 A I CES'l -- �+ City Clerk�� APPROVED AS TO FORM J' Mi—risiine Dietrick Citv Attorney
