Four years ago, the review of a proposal for a hotel at 1845 Monterey Street was fraught with controversy because of disagreements over the wording and intent of Ordinance 1130. After the building was approved, all parties agreed that the wording of the Ordinance needed to be clarified and strengthened to avoid future difficulties in interpretation. When the LUCE 2035 document prompted an update to zoning regulations, the City invited us to present our version of a revision of Ordinance 1130 to more nearly reflect the intent of the original 1989 ordinance as well as lessons learned from the hotel review. On January 10, this year, we presented our update to you. At the end of your discussion, Chair Stevenson directed Deputy Director Davidson to represent you in negotiating an agreement with us. That negotiation was successfully concluded on June 2, and is found on pp. 511-513 of the markup version of the Draft Zoning Regulations Update. On behalf of the working group from the San Luis Drive neighborhood, I am pleased to inform the Planning Commissioner of our full endorsement of the agreement negotiated between us and Doug Davidson and Kyle Bell. Although we did not achieve all of our goals, particularly our desire for greater setbacks and for a reduction in allowed height, we believe that the other changes propose provide better protection of the creek and our neighborhood. The strengthened and clarified wording is indeed comforting to our neighborhood. Thank you for allowing us to be actively involved in drafting the revision. We deeply appreciate how forthcoming the City has been in accommodating our concerns. We hope that you will endorse the current statement and recommend it for adoption to the City Council in toto.
