AGREEMENT CONDITIONS OF USE FOR ACCESSORY DWELLING UNIT An Agreement between Patrick John Herrero and Suzanne Herrero and the City of San Luis Obispo regarding Conditions of Use for an Accessory Dwelling Unit for the property in the City of San Luis Obispo at: 228 Albert Drive (APN: 052-321-017) This agreement is made and entered into this __& day of _J_L)jjq 20_0 by and between Patrick John Herrero and Suzanne Herrero (hereinafter called "Owners") and the CITY OF SAN LUIS OBISPO, A MUNICIPAL CORPORATION, (hereinafter called "City"). WITNESSETH WHEREAS, Owners are the owners of that certain real property located in the City of San Luis Obispo, County of San Luis Obispo, State of California, described as Lot 17 in Block A of Tract 64, Alta Vista, as shown on map filed in Book 5 of Maps at Page 79, in the Office of the County Recorder of said County (the "Property"); and WHEREAS, Owners have made application with City to modify or to construct an addition to an existing structure or to build a new structure, described and delineated on plans submitted with Building Permit application BLDG -0796-2018 for construction of an Accessory Dwelling Unit, as defined in Chapter 17.21 of the Municipal Code; and NOW, THEREFORE, in consideration of the above recitals and mutual covenants, terms, conditions and restrictions contained herein, Owners hereby declare that the Property shall be held, transferred, encumbered, used, sold, conveyed, leased, and occupied subject to this Agreement (and incorporating the above recitals herein by this reference) which shall run with the land and shall be binding upon Owners' heirs, successors in interest, legal representatives, administrators, grantees, assigns, lessees, or any other occupiers and users of the Property, or any portion of it, as follows: 09,141A'A-L- 1) The parties hereto agree that execution of this agreement by Owners and City entitles Owners to proceed to modify or construct the structure depicted in plans submitted with the above -referenced building permit application; and 2) Owners agree that: a) The primary unit or the Accessory Dwelling Unit shall be "owner -occupied" b) Owners agree to occupy either the primary residence or the accessory dwelling unit as Owners' primary residence. c) The required number of parking spaces shall be maintained for the primary residence as showed on building plans; IN WITNESS WHEREOF, the parties hereto have executed this agreement on the day and year first written above. l Date Date NOTARIZED Patrick John Herrero Suzanne Herrero (,(20([C V�.
