Hagerty ----------- Deputy Secretary of Statc I —3— s CHAPTER_Rf2__ Senate Concurrent Resolution No. 35—Relative to approving certain amendments to the charter of the City of San Luis Obispo, a municipal corporation in the County of San: Luis Obispo, State of California, voted for and ratified by the qualified electors of said city at the general municipal elec- tion held therein on the seventh day of April, 1947. WHEREAS, Proceedings have been taken and had for the proposal, adoption and ratification of certain amendments hereinafter set forth to the charter �of the City of San Luis Obispo, a municipal corporation in the County of San Luis Obispo, State of California, as set out in the certificate of the mayor and city clerk of said city, as follows, to wit: 1 CERTIFICATE OF ADOPTION BY THE QUALIFIED ELECTORS OF THE CITY OF SAN LUIS OBISPO OF CERTAIN AMENDMENTS OF THE CHARTER OF THE CITY OF SAN LUIS OBISPO, STATE OF CALIFORNIA STATE OF CALIFORNIA, COUNTY OF SAN LUIS OBISPO, SS CITY OF SAN LUIS OBISPO. We, Ralph C. Kennedy, Mayor of the City of Sail Luis Obispo and J. E. Brown, City Clerk of the City of San Luis Obispo, do hereby certify as follows: That said City of San Luis Obispo, in the County. of San d Luis Obispo, State of California, is now, and was at all times herein mentioned a city containing a population of more than three thousand five hundred inhabitants, but less than fifty thousand inhabitants, as ascertained by the last preceding census taken under authority of the Congress of the United States; and, That said City of San Luis Obispo is now, and was at all of the times herein mentioned, organized and existing under a freeholder's charter adopted under the provisions of Section Eight, of Article Eleven, of the Constitution of the State of Cali- fornia' -which charter was duly ratified by a majority of the electors of said city at a special election held therein on the 12th day of September, 1910, and approved by the Legislature of the State of California, by Concurrent Resolution, filed with the Secretary of State, February 23, 1911 (Statutes of 1911, Page 1698) ; and, 4 That, pursuant to the provisions of Section Eight of Article Eleven of the Constitution of the State of Cali- e fornia, the Legislative body of said city, namely; the City Coun- cil of said city did, on its own motion and pursuant to the pro- visions of Section Eight of Article Eleven of the Constitution of the State of California, duly propose to the electors of said City of San Luis Obispo three amendments to the charter of said city and ordered that said amendments be submitted to said electors at the general municipal election to be held in said city on the 7th day of April, 1947; and, That said proposed amendments were, .and each of them was, on the 19th day of February, 1947, duly published in the Telegram -Tribune, a daily newspaper of general circulation published in said City of San Luis Obispo, and the newspaper designated by said City Council for that purpose, and in each and every edition thereof published on said day, as appears from the affidavit of publication now on file; and ' That said proposed amendments were printed in con- venient pamphlet form in type of not less than ten -point, and from the 19th day of February, 1947, to the 7th day of April, 1947, both inclusive, a notice was published in said Telegram - Tribune that such copies could be had upon application there- for at the office of the City Clerk of said city, as appears from the affidavit of publication now in file; and, That said City Council did, by an election proclamation and resolution which was duly adopted on the 19th day of March, 1947, order the holding of the general municipal elec- tion and consolidated charter amendment election in said City of San Luis Obispo, on the 7th day of April, 1947, which date was not less than forty days and not more than sixty days after the completion of the publication of said proposals of amend- ment to the charter of the City of San Luis Obispo, as afore- said, and which election proclamation and resolution was pub- lished at least once a week for two successive weeks prior to said election, in the Telegram -Tribune, a newspaper of general circulation printed and published in said city; and, That said general municipal election and consolidated charter amendment election was held in said City of San Luis Obispo on said 7th day of April, 1947, and that at such election, held as aforesaid, a majority of the qualified voters of said City of San Luis Obispo voting thereon voted in favor of said three proposals of amendment, to the charter of the City of San Luis Obispo, and duly ratified the same; and, That said proposals of amendment to the charter of the City of San Luis Obispo so ratified as aforesaid, were and are amendments known as and numbered, Charter Amendment No. 1, Charter Amendment No. 2 and Charter Amendment No. 3 ; and, — 5 That the City Council of said City of San Luis Obispo. after duly and regularly canvassing the return of said election, at the time and in the manner and form prescribed by law, duly found, determined and declared that a majority of the qualified voters voting thereon voted in favor of and ratified said proposals of amendment to the Charter of the City of San Luis Obispo known as Charter Amendment No. 1, Charter Amendment No. 2 and Charter Amendment No. 3; and, That said proposals of amendment to the Charter of the City of San Luis Obispo ratified by the electors of said city, as aforesaid, are in the words and figures as follows, to -wit: CHARTER AMENDMENT No. I That Section 122 of Article XIX of the Charter of the City of San Luis Obispo be amended so that the same shall be and read as follows: Sec. 122. Notwithstanding anything to the contrary con- tained in Section 54 of this charter, and in addition to the tax levies therein provided, the council may in any year levy a tax in the same manner as other taxes are levied, of not to exceed twenty cents on each one hundred dollars worth of taxable property in said city which shall be collected at the same time and in the same manner as other taxes levied by said city, the proceeds of which tax shall belong to and be paid to the Park, Playground and Recreation Fund, which fund is hereby created, and shall be expended only for park, playground and recreation purposes. CHARTED AMENDMENT No. 2 That Section 61 of Article X of the Charter of the City of San Luis Obispo be amended so that the same shall be and read as follows: Sec. 61. PUBLIC WORK TO BE DONE BY CON- TRACT. _ In the erection, improvement and repair of all pub- lic buildings and public works; in all street and sewer work, and in furnishing any supplies and materials for the same, or for any other use by the city, when the expenditure required for the same exceeds the sum of two thousand dollars, the same shall be done by contract, and shall be let, to the lowest responsible bidder, after advertising for sealed proposals for the work contemplated for one day in the official newspaper. Such notice shall distinctly and specifically state the work con- templated to be done. Provided, however, the council may reject any and all bids, if deemed excessive, and re -advertise for bids, or may require the commissioner of public works to submit a detailed estimate of what the work may be done for by the department of public works, and if such estimate is I. -6— lower than the lowest bid, the council may order the work to be done by.the department of public works, but the department of public works must not be allowed a larger sum to complete such work than called for by the aforesaid estimate. In case no bid is received, the council may provide for.the work to be done by the department of public works. CHARTER AMENDMENT No. 3 That Section 72 of Article XIV of the Charter of the City of San Luis Obispo be amended so that the same shall be and read as follows: Sec. 72. MODE OF PROTESTING AGAINST ORDI- NANCES. No ordinance passed by the council shall go into effect before thirty days from the time of its final passage except when otherwise required by the general laws of the State or by the provisions of this charter respecting street improve- ; meats, and except the ordinance making the annual tax levy, and except an ordinance for the immediate preservation of the public peace, health or safety, which contains a • statement of its urgency, and is passed by a four-fifths vote of the coun- cil; provided, that no grant of any franchise shall be con- structed to be an urgency measure, but all franchises shall be subject to the referendum vote herein provided. If during said thirty days a petition signed by qualified electors of the city equal in number to at least twenty per centum of the entire t vote cast for all candidates for mayor at the last preceding general municipal election at which a mayor was elected, pro- testing against the passage of such ordinance, be presented to the council, the same shall thereupon be suspended from going into operation and it shall be the duty of the council to reconsider such ordinance, and if the same be not entirely repealed, the council shall submit the ordinance; as is provided t in Article XIII of this charter, to the vote of the electors of the city, either at the next general municipal election or at a special election to be called for that purpose, and such ordinance shall not go into effect or become operative unless a majority of the qualified electors voting on the same shall vote in favor thereof. The provisions of Section sixty-eight of Article XI respecting the forms and conditions of the petition and the mode of verification and certification and filing shall be sub- stantially followed, with such modifications as the nature of the case requires. That the foregoing is a full, true and correct copy of said proposals of amendment to the charter of the City of San Luis Obispo, ratified by the electors of said city, as aforesaid, on file in the office of the City Clerk of said City of San Luis Obispo, 7 IN WITNESS WHEREor, We have hereunto set our hands s and caused the seal of the City of San Luis Obispo to be here- unto affixed, on this 14th day of April, 1947. BROWN City Clerk of the City of San Luis Obispo and WHEREAS, The said proposed amendment as ratified as hereinabove set forth has been and is now duly presented and ` submitted to the Legislature of the State of California for approval or rejection as a whole without power of alteration in accordance with Section 8 of Article XI of the Constitution of the State of California; now therefore, be it Resolved by the Senate of the State of California, the Assembly concurring, A majority of all the members elected to each house voting therefor and concurring therein, that said amendments to the charter of the City of San Luis Obispo as proposed to, and adopted and ratified by the electors of the said city as hereinbefore fully set forth, be and the same is hereby approved as a whole, without amendment or alteration, for and as amendments to and as parts of the charter of the said City, of San Luis Obispo. Constitution of the State of Cali- fornia, the Legislative body of said city, namely; the City Coun- cil of said city did, on its own motion and pursuant to the pro- visions of Section Eight of Article Eleven of the Constitution of the State of California, duly propose to the electors of said City of San Luis Obispo three amendments to the charter of said city and ordered that said amendments be submitted to said electors at the general municipal election to be held in said city on the 7th day of April, 1947; and, That said proposed amendments were, and each of them was, on the 19th day of February, 1947, duly published in the Telegram -Tribune, a daily newspaper of general circulation published in said City -of San Luis Obispo, and the newspaper designated by said City Council for that purpose, and in each and every edition thereof published on said day, as appears from the affidavit of publication now on file; and That said proposed amendments were printed in con- venient pamphlet form in type of not less than ten -point, and from the 19th day of February, 1942, to the 7th day of April, 1947, both inclusive, a notice was published in said Telegram - Tribune that such copies could be had upon application there- for at the office of the City Clerk of said city, as appears from the affidavit of publication now in file; and, That said City Council did, by, an election proclamation and resolution which was duly adopted on the 19th day of March, 1947, order the holding of the general municipal elec- tion and consolidated charter amendment election in said City of San Luis Obispo, on the 7th day of April, 1947, which date was not less than forty days and not more than sixty days after the completion of the publication of said proposals of amend- ment to the charter of the City of San Luis Obispo, as afore- said, and which election proclamation and resolution was pub- lished at least once a week for two successive weeks prior to said election, in the Telegram -Tribune, a newspaper of general circulation printed and published in said city; and, That said general municipal election and consolidated charter amendment election was held in said City of San Luis Obispo on said 7th day of April, 1947, and that at such election, held as aforesaid, a majority of the qualified voters of said City. of San Luis Obispo voting thereon voted in favor of said three proposals of amendment to the charter of the City of San Luis Obispo, and duly ratified the same; and, ' That said proposals of amendment to the charter of the City of San Luis Obispo so ratified as aforesaid, were and are amendments known as and numbered, Charter Amendment No. 1, Charter Amendment No. 2 and Charter Amendment No. 3; and, 5 — That the City Council of said City of San Luis Obispo. after duly and regularly canvassing the return of said election, at the time and in the manner, and form prescribed by law, duly found, determined and declared that a majority of the qualified voters voting thereon voted in favor of and ratified said proposals of amendment to the Charter of the City of San Luis Obispo known as Charter Amendment No. 1, Charter Amendment No. 2 and Charter Amendment No. 3; and, That said proposals of amendment to the Charter of the City of San Luis Obispo ratified by the electors of said city, as aforesaid, are in the words and figures as follows, to -wit: CHARTER A31ENDMENT No. 1 That Section 122 of Article XIX of the Charter of the City of San Luis Obispo be amended so that the same shall be and read as follows: Sec. 122. Notwithstanding anything to the contrary con- tained in Section 54 of this charter, and in addition to the tag levies therein provided, the council may in any year levy a tag in the same manner as other taxes are levied, of not to exceed twenty cents on each one hundred dollars worth of taxable. property in said city which shall be collected at the same time and in the same manner as other taxes levied by said city, the proceeds of which tax shall belong to and be paid to the Park, Playground and Recreation Fund, which fund is hereby created, and shall be expended only for park, playground and recreation purposes. CHARTER AMENDMENT No. 2 That Section 61 of Article X of the Charter of the City of San Luis Obispo be amended so that the same shall be and read as follows: Sec. 61. PUBLIC WORK TO BE DONE BY CON- TRACT. In the erection, improvement and repair of all pub- lic buildings and public works, in all street and sewer work, and in furnishing any supplies and materials for the same, or for any other use by the city, when the expenditure required for the same exceeds the sum of two thousand dollars, the same shall be done by contract, and shall be let, to the lowest responsible bidder, after advertising for sealed proposals for the work contemplated for one day in the official newspaper. Such notice shall distinctly and specifically state the work con- templated to be done. Provided, however, the council may reject any and all bids, if deemed excessive, and re -advertise for bids, or may require the commissioner of public works to submit a detailed estimate of what the work may be done for by the department of public works, and if such estimate is -6— lower than the lowest bid, the council may order the work to be done by the department of public works, but the department of public works must not be allowed a larger sum to complete such work than called for by the aforesaid estimate. In case no bid is received, the council may provide for the work to be done by the department of public works. CHARTER AMENDMENT No. 3 That Section 72 of Article XIV of the Charter of the City of San Luis Obispo be amended so that the same shall be and read as follows: Sec. 72. MODE OF PROTESTING AGAINST ORDI- NANCES. No ordinance passed by the council shall go into effect before thirty days from the time of its final passage except when otherwise required by the general laws of the State or by the provisions of this charter respecting street improve- ments, and except the ordinance making the annual tax levy, and except an ordinance for the immediate preservation of the public peace, health or safety, which contains a statement of its urgency, and is passed by a four-fifths vote of the coun- cil; provided, that no grant of any franchise shall be con- structed to be an urgency measure, but all franchises shall be subject to the referendum vote herein provided. If during said thirty days a petition signed by qualified electors of the city equal in number to at least twenty per centum of the entire vote cast for all candidates for mayor at the last precedin.- general municipal election at which a 'mayor was elected, pro- testing against the passage of such ordinance, be presented to the council, the same shall thereupon be suspended from going into operation and it shall be the duty of the council to reconsider such ordinance, and if the same be not entirely repealed, the council shall submit the ordinance, as is provided in Article XIII of this charter, to the vote of the electors of the city, either at the next general municipal election or at a special election to be called for that purpose, and such ordinance shall not go into effect or become operative unless a majority of the qualified electors voting on the same shall vote in favor thereof. The provisions of Section sixty-eight of Article XI respecting the forms and conditions of the petition and the mode of verification and certification and filing shall be sub- stantially followed; with such modifications as the nature of the case requires. Retire- ment Act, making the employees of the City members of said Retirement System. Plenary authority and power is hereby vested in the City of San Luis Obispo, its City Council, and its several officers, agents and employees to do and perform any act, or exercise any authority granted, permitted or required, whereby said City, under the provisions of said Retirement Act, may become a contracting City fully par- ticipating in the State Employees' Retirement System, on the same basis as State employees, wherever and whenever said Retirement Act permits; provided, however, that the City Council, by ordinance duly adopted, may terminate any contract entered into with the Board of Administration of the State Employees' Retirement System. The Retirement Act herein referred to is that certain act of the Legislature of the State of California (Statutes of 1931, Chapter 700), cited as the State Employees' Retirement Act, as now amended, or as the same may hereafter be amended. The employees of the Public Library, the Judge of the Police Court and the Chief Officials of the City named in Sec- tion 26 of this Charter, except Library Trustees, shall be con- sidered and held to be employees of the City of San Luis Obispo for the purpose of the establishment and maintenance of the retirement system hereby authorized. -6— The City Council, in any year, by ordinance adopted not later than the first Tuesday in September, may levy a tax sufficient to pay all costs and expenses to be paid by the City during the fiscal year then current, to enable said City to par- ticipate in the State Employees' Retirement System, and, notwithstanding anything to the contrary therein contained, the limitations of Article IX, Section 54, of the Charter of the City of San Luis Obispo, with respect to the levy and col- lection of municipal taxes, shall not apply to any tax author- ized by this Article. " CHARTER AMENDMENT NO. 2 That Section 54 of Article IX of the Charter of the City of San Luis Obispo be amended so that the same shall be and read as follows: Sec. 54 LIMIT OF TAX LEVY. The tax levy aithor- ized by the council for any one year for all municipal pur- poses, other than for the payment of principal or interest on any bonds of the city, or for school purposes, or for public library purposes, shall not exceed eighty-five cents on each one hundred dollars worth of taxable property in said city, except as in this charter otherwise provided. The council may, how- ever, in any year, by ordinance adopted not later than the first Tuesday in September, levy in addition to the rate in this section above authorized, a tax of not to exceed thirty cents on each one hundred dollars worth of taxable property in said city, which shall be collected at the same time and man- ner as other taxes levied by said city, the proceeds of which said tax shall belong and be paid to a fund designated as the Improvement Fund of said City and shall be expended only for public improvements and betterments in said city. The council may, how- ever, in any year, by ordinance adopted not later than the first Tuesday in September, levy in addition to the rate in this section above authorized, a tax of not to exceed thirty cents on each one hundred dollars worth of taxable property in said city which shall be collected at the same time and man- ner as other taxes levied by said city, the proceeds of which said tax shall belong and be paid to a fund designated as the Improvement Fund of said City and shall be expended only for public improvements and betterments in said city. That the foregoing is a full, true and correct copy of said pro- posals of amendment to the charter of the City of San Luis Obispo, ratified by the electors of said city, as aforesaid, on file in the office of the City Clerk of said City of San Luis Obispo. That said general municipal election and consolidated char- ter amendment election was held in said City of San Luis Obispo on said 5th day of April, 1943, and that at such elec- tion, held as aforesaid, a majority of the qualified voters of said City of San Luis Obispo voting thereon voted' in favor of said two proposals of amendment to the charter of the City of San Luis Obispo, and duly ratified the same; and, That said proposals of amendment to the charter of the City of San Luis Obispo so ratified as aforesaid, were and are amendments known as and numbered, Charter Amendment No. 1 and Charter Amendment No. 2; and, C —5— That the City Council of said City of San Luis Obispo, after duly and regularly canvassing the return of said election, at the time and in the manner and form prescribed by law, duly found, determined and declared that a majority of the quali- fied voters voting thereon voted in favor of and ratified said proposals of amendment to the charter of the City of San Luis Obispo known as charter amendment No. 1 and charter amendment No. 2; and, That said proposals of amendment to the Charter of the City of San Luis Obispo ratified by the electors of said city, as aforesaid, are in words and figures as follows, to -wit: CHARTER AMENDMENT NO. 1 That Section 15 of Article III of the charter of the City of San Luis Obispo be amended so that the same shall be and read as follows: Sec..15 SALARIES. The mayor shall receive .an annual salary of sig 'hundred dollars, payable in equal monthly installments. Each councilman shall receive an annual salary of five hun- dred dollars, payable in equal monthly installments. The city .council shall regulate the compensation of the city clerk and shall regulate the number, method of appointment, terms of office or employment, and compensation of any deputy or assistant city -clerk and all employees in the office of the city clerk. Each` school director shall receive two and one-half dollars for each regular meeting of the board of education which he shall attend, provided that he shall not receive more than 10 dollars in'any one month. The provisions of this section in reference to the compensa- tion of the city clerk shall apply- to the person elected as city clerk at the election at which this amended section is adopted. CHARTER AMENDMENT NO. 2 That Section 52 of Article IX of the charter of the City of San Luis Obispo be amended so that the same shall be and read as follows: Sec. 52 BOARD OF EQUALIZATION. The Council shall meet at their usual place of holding meetings on the first Monday in July of each year, at ten o'clock in the forenoon of said day, and sit as a board of equalization and shall con- tinue in session for that purpose, from time to time, until the business of equalization is disposed of, but not later than the third Monday in July. To provide for the sale at public auction, after advertising for one day, of personal property unfit or unnecessary for the use of the city; provided that no such sale shall be held less than five (5) days after such advertising. PROPOSED CHARTER AMENDMENT NO. 4 That Section 61 of Article X of the Charter of the City of San Luis Obispo be amended so that the same shall be and read as follows: Sec. 61. PUBLIC WORK TO BE DONE BY CON- TRACT. In the erection, improvement and repair of all pub- lic buildings and public works, in all street and sewer work, and in furnishing any supplies and materials for the same, or for any other use by the city, when the expenditure required for the same exceeds the sum of three hundred dollars, the same shall be done by contract, and shall be let to the lowest responsible bidder, after advertising for sealed proposals for the - work contemplated for one day in the official newspaper. Such notice shall distinctly and specifically state the work contemplated to be done. Provided, however, the council may reject any and all bids, if deemed excessive, and re -advertise for bids, or may require the commissioner of public works to submit a detailed estimate of what the work may be done for by the department of public works, and if such estimate is lower than the lowest bid, the council may order the work to be done by the department of public works, but the department of public works must not be allowed a larger sum to complete such work than called for by the afore- said estimate. In case no bid is received, the council may provide for the work to be done by the department of public works. PROPOSED CHARTER AMENDMENT NO. 5. That Section 62 of Article X of the charter of the City of San Luis Obispo be amended so that the same shall be and read as follows: Sec. 62. CONTRACTS FOR ADVERTISING. The Council shall let annually contracts for the official advertising for the ensuing fiscal year. For this purpose the council shall advertise for one day, setting forth distinctly and specifically -7— the work contemplated to be done, and asking for sealed pro- posals therefor. The proposals shall specify the type and spac- ing to be used at the rate or rates named in the bids. The council shall let the contract for such official advertising to the lowest responsible bidder publishing a newspaper of general circulation printed and published in the city and which has been in existence at the time of the awarding of the contract for at least one year; provided, that the council may reject any or all bids if found excessive, and advertise for new bids. The newspaper to which the award of such advertising is made shall be known and designated as the "official news- paper ". PROPOSED CHARTER AMENDMENT NO. 6 That Section 68 (13) of Article XI of the charter of the y City of San Luis Obispo be amended so that the same shall be and read as follows: Sec. 68 (13). Immediately after such petitions are filed, the clerk shall enter the names of the candidates in a list, with the offices to be filled, and shall not later than twenty (20) days before the election certify such list as being the list of candidates nominated as required by the charter of the City of San Luis Obispo, and the council shall cause said cer- tified list of names and the offices to be filled, designating whether for a full term or unexpired term to be published in • the proclamation calling the election at least once a week for two successive weeks before the election in not more than two newspapers of general circulation printed and published in the City of San Luis Obispo. Said proclamation shall con- form in all respects to the general state law governing the conduct of municipal elections, now or hereafter in force, except as above required. To the honorable mayor and city council of the city of San Luis Obispo, State of California: The undersigned registered electors of the city of San Luis Obispo, State of California, hereby submit the following pro- posals for the amendment of the city charter of said city of San Luis Obispo, State of California, and request that such proposals be submitted to the electors of said city at the general municipal election to be held on the third day of April, 1933, to wit: CHARTER AAIENDAIENT No. 1. That section 4 of said charter be amended to read as follows: See. 4. TIE ELECTIVE OFFICERS. The elective officers of the city shall be a mayor, a city clerk, four council- men and five school directors. The council shall consist of the mayor and four council- men, each of whom shall, including the mayor, have the right to vote on all questions coming before the council. The board of education shall consist of five school directors, each of whom shall have -the right to vote on all questions coming before the board. -5— CHARTER A.NIENDAIENT No. 2. That subdivision 9 of section 40 of said charter be amended to read as follows: (9) Every resolution or ordinance which may have been passed by the city council shall, before it becomes a law or effective as a resolution, be presented to the mayor. If he approves it, he shall sign it; but, if not, he shall return it, with his objections, to the city council by filing the same with the city clerk, who shall enter such objections upon the minute book of the council, and thereupon the city council at its next regular meeting shall proceed to reconsider such resoln- tion or ordinance, and, if after such reconsideration the coun- cil again passes such resolution or ordinance, by yeas and nays, three members of the council voting therefor, it shall become a law or become effective, notwithstanding the mayor's objections. If any resolution or ordinance shall not be returned to the city clerk within ten days after it shall have been presented to him, (Sundays excepted), the same shall become a law or become effective in like manner as if he had signed it. CHARTER AMENDAIENT No. 3. That a new section, to be known as section 56-a be added to said charter, as follows: See. 56-a. CLAIMS AGAINST THE CITY. CLERK'S AVARR•ANT. All demands against the city shall be presented to and audited by the city council; and upon the allowance of such demand by the affirmative vote of three members of the council, the city clerk shall draw a warrant on the treas- ury for the same, which warrant shall not require any counter- signature, and the same shall specify for what purpose the same is drawn and out of what fund it is to be paid. WHEREAS, The city of San Luis Obispo in the county of San Luis Obispo, State of California, is now and was at all times herein mentioned a city containing a population of more than three thousand five hundred inhabitants ascertained by the last census taken under authority of the congress of the United States, and is now organized and acting under a free- holders' charter adopted under and by virtue of section 8 of article eleven of the constitution, which charter was duly ratified on the twelfth day of September, 1910, approved and ratified by the Legislature of the State of California by con- current resolution filed with the secretary of state February 23, .1911, and WHEREAS, Proceedings have been duly had and taken for the proposal, submission, adoption and ratification of a cer- tain amendment to the charter of the city of San Luis Obispo as set out in the certificate of the mayor and city clerk of said city of San Luis Obispo, to wit: Certificate of adoption by the qualified electors of the city of San Luis Obispo at the general municipal election held therein on the first day of April, 1929, of an amendment to the charter of the city of San Luis Obispo, State of Cali- fornia. State of California, 1 County of San Luis Obispo, } ss. City of San Luis Obispo. We, L. F. Sinsheimer, mayor of the city of San Luis Obispo, and Callie M. John, city clerk of the city of San Luis Obispo, do hereby certify as follows: That said city of San Luis Obispo, in the county of San Luis Obispo, State of California, is now, and was at all times herein mentioned, a city containing a population of more than three thousand five hundred inhabitants as ascertained by the last preceding census taken under the authority of the congress of the United States; and, That said city of San Luis Obispo is now, and was at all of the times herein mentioned, organized and existing under a freeholders' charter adopted under the provisions of section 8, article eleven, of the constitution of the State of California, which charter was duly ratified by a majority of the electors E of said city at a special election held therein on the twelfth day of September, 1910, and approved by the Legislature of the State of California, by concurrent resolution, filed with the secretary of state, February 23, 1911 (statutes 1911, page 1698) ; and, That, pursuant to the provisions of section 8 of article eleven of the constitution of the State of California, the legislative body of said city, namely: The city council of said city did, on its own motion and pursuant to the provisions of section 8 of article eleven of the constitution of the State of California, duly propose to the electors of said city of San Luis Obispo an amendment to the charter of said city and ordered that said amendment be submitted to said electors of said city at the general municipal election to be held in said city on the first day of April, 1929; and, That said proposed amendment was, on the nineteenth day of February, 1929, duly published in the Daily Telegram, a daily newspaper of general circulation published in said city of San Luis Obispo, and the newspaper designated by said city council for that purpose; That said proposed amendment was printed in convenient pamphlet form, and from the nineteenth day of February, 1929, to the first day of April, 1929, both inclusive, a notice was published in said Daily Telegram that such copies could be had upon application therefor at the office of the city clerk of said city; and, That said city council did, by an election proclamation and resolution which was duly adopted on the twelfth day of March, 1929, order the holding of the general municipal elec- tion and consolidated charter amendment election in said city of San Luis Obispo, on the first day of April, 1929, which date was more than forty days and less than sixty days after the completion of the publication of said proposal of amendment to the charter of the city of San Luis Obispo, as aforesaid, and which election proclamation and resolution was published at least ten successive days prior to said election, in the Daily Telegram, a newspaper of general circulation printed and published in said city; and, That said general municipal election was held in said city of San Luis Obispo on said first day of April, 1929, which election was held after the six months next preceding a regu- lar session of the Legislature of the State of California and before the adjournment of that session; That at such general municipal election, held as aforesaid, a majority of the qualified voters of said city of San Luis Obispo, voting thereon, voted in favor of said proposal of amendment to the charter of the city of San Luis Obispo, and duly ratified the same; `�J -5 That said proposal of amendment to the charter of the city of San Luis Obispo so ratified, as aforesaid, was and is amendment numbered five; and That the city council of said city of San Luis Obispo, after duly and regularly canvassing the returns of said general municipal election at the time and in the manner and form prescribed by law, duly found, determined and declared that a majority of the qualified voters, voted in favor of and rati- fied said proposal of amendment to the charter of the city of San Luis Obispo known as charter amendment numbered five; and, That said proposal of amendment to the charter of the city of San Luis Obispo ratified by the electors of said city, as aforesaid, is in words and figures as follows, to wit. Charter Amendment No. 5. Section 54 of article nine of the charter of the city of San Luis Obispo is hereby amended so that the same shall be and read as follows: See. 54. LIMIT or TAx LEvY. The tax levy authorized by the council for any one year for all municipal purposes, other than for the payment of principal or interest on any bonds of the city, or for school purposes, shall not exceed eighty-five cents on each one hundred dollars worth of taxable property in said city, except as herein provided. The council may, however, in any year, by ordinance adopted not later than the first Tuesday in September, levy in addition to the rate in this section above authorized, a tax of not to exceed fifteen cents on each one hundred dollars worth of taxable property in said city which shall be collected at the same time and manner as other taxes levied by said city, the proceeds of which said tax shall belong and be paid to a fund designated as the improvement fund of said city and shall be expended only for public improvements and betterments in said city. That the foregoing is a full, true and correct copy of said proposal of amendment to the charter of the city of San Luis Obispo, ratified by the electors of said city, as aforesaid, on file in the office of the city clerk of said city of San Luis Obispo.
