MOBILEHOME RENT REVIEW BOARD
FEBRUARY 5, 1987

I. WELCOME/INTRODUCTIONS

Chairperson Pat Barlow declared the regular meeting of the
Mobilehome Rent Review Board come to order at 1:30 p.m. with the
following in attendance:

The minutes of the meeting of January 22, 1987 were approved as
mailed.
III. REVIEW OF PACKET

Mr. Henderson reviewed the packet presented to the Board, which
included: 1. minutes and agenda; 2. copies of rent control
ordinances from the Cities of Simi Valley and San Jose; 3. list
of issues priorities established at last meeting; 4. letter from
City Attorney to the Council, re: resolution of dispute in local
mobilehome park concerning the issue of a recreational vehicle.
IV. CONSIDERATION_ OF ADJUSTMENTS_ TO THE RENT_ STABILIZATION_ ORDINANCE
A subcommittee consisting of staff and two Boardmembers recapped
for the audience the substance of their phone surveys with the
Cities of Lancaster, Rocklin, and Simi Valley. This study came at
the request of the Board at the last meeting, with the intention
of educating the Board concerning other municipalities experience
with the processes of mediation and arbitration. The Board
desired to understand these alternative methods utilized by other
cities in a given rent stabilization program, so that they will
have a broad range of information as they consider procedural and

administrative adjustments to the rent stabilization ordinance.

The Board entered into discussions on the issues agreed upon at
the last meeting. Item #1 concerned the consideration of
replacing the present rent stabilization ordinance with a new
formula based upon tenant economic need. Possible guidelines for
determining whether or not a tenant is eligible for protection
under such a formula would parallel those standards set forth by
the state and federal government in the provision of their rental
subsidies.
The Board opened up the issue to public comment, and a total of
four speakers addressed the Board: Leola Rubottom, Ward Spencer,
Dick Clark, and Jim Buttery. The first three listed are residents
of various mobilehome parks and spoke out against the concept of
this new formula. Jim Buttery represents various parkowners in
the area and spoke in favor of this new formula proposal,
especially as it encourages long-term leases. The Board closed
the issue to public comment and began discussion among itself.
The Board returned to the matter of establishing issue priorities
and found there was not majority support for a new formula based
on tenant economic need in the proposal's present form. The Board
did, however, choose to pursue the matter at a latter date after
more information was available. The Board then moved to Item #2
on its discussion list, the issue of Safe Harbor.
MOTION: "That the Board go on record as favoring the Safe Harbor
concept at a factor of 66.66%, plus protection for the remaining
33^33% protected as under current state la_w (Wheeler, Grden) A
voice vote was taken with the following record: AYES -3, NAYES-2.
Motion carried.
The Board took a 10 minute recess from 3:30 - 3:40 p.m..
The Board took up Item #3, Vacancy Decontrol/Change of Occupancy.
The Board accepted public comments from the following: Leola
Rubottom, Ward Spencer, Jim Buttery, and David Evans. The first
two folks, mobilehome residents, spoke out against the concept of
Vacancy Decontrol being added to the Ordinance. The other two
speakers, representing parkowners, spoke in favor of such a
provision.
MOTION: "To amend the Ordinance allowing Vacancy Decontrol/Change

of Occupancy at a factor of 20% over then existing space rent,
with a hardship exclusion for surviving spouses" (Grden, Wheeler)

A voice vote was taken with the following record: AYES -2,
NAYES-3. Motion defeated.
MOTION: "To amend the Ordinance so that any park that has 20% or
more of residents on long-term leases is allowed to practice
_Vancancy Decontrol/Change of Occupancy with a factor of 20% over
the then existing space rent with theexclusion for surviving
spouses " (Grden, Wheeler) After discusion, motion withdrawn.
MOTION: "That _Vacancy Decontrol/Change of Occupancy be put into
effect at 15%, with the exclusion for surviving spouses."
(Wheeler, Grden) A voice vote was taken with the following
record: AYES -3, NAYES-2. Motion carried.
V. ADJOURN
The meeting was adjourned at 5:00 p.m.. The next meeting is
scheduled for February 19, 1987 at 1:30 p.m..
