A Rescheduled Regular Meeting of the San Luis Obispo City Council was called to order on
Tuesday, January 8, 2019 at 6:00 p.m. in the Council Chamber, located at 990 Palm Street, San
Luis Obispo, California, by Mayor Harmon.

By consensus the Council agreed to have the Mayor and Vice Mayor reach out to the School
Board to see if they would be interested in having some sort of liaison relationship with the

5. ORDINANCE ADOPTION - COMPREHENSIVE ZONING REGULATIONS
FOLLOW-UP ITEMS
ACTION: MOTION BY VICE MAYOR PEASE, SECOND BY COUNCIL
MEMBER GOMEZ, CARRIED 5-0 to reintroduce the Ordinance with the following new
condition to Section E1:
h. Energy Efficiency. Applications submitted for tiny houses shall demonstrate that the
tiny home has been constructed to exceed ANSI energy standards through one of the
following methods:
i. Include insulation with values of R13 for the walls and R19 for the floor and ceiling;
or

ii. Ensure that the stud/joist/rafter space in the walls, floors and ceiling are completely

6. APPROVAL OF FINAL MAP FOR TRACT 2428-3 (3000 CALLE MALVA)
CARRIED 5 – 0 to adopt a Resolution entitled, “A Resolut ion of the City Council of the
City of San Luis Obispo, California, Approving the Final Map for Tract 2428 -3 (3000 Calle
Malva, Tr 121-13),” and authorizing the Mayor to execute a Subdivision Agreement and a
Conservation Easement.
7. TRANSIT - AUTOMATIC VEHICLE LOCATION SYSTEM PURCHASE
CONTRACT AMENDMENT
CARRIED 5 – 0 to:
1. Amend the Transit Automatic Vehicle Locator (AVL) Replacement CIP Budget (2017-19
Financial Plan) by:
a. Appropriating $11,492 in additional Proposition 1B for the project; and
b. Programming $45,000 in unappropriated Transit Fund working capital for the local
match on the project.
2. Authorize the City Manager to execute a contract amendment with First Transit Inc., not
to exceed $373,000 for the purchase of an AVL System as proposed

Christianson to an ad ho c committee to work with staff to review and revise the legislative
platform and return to City Council at the March 5th meeting and to continue under the
current legislat ive platform until the revised document is approved.

10. FACILITIES MASTER PLAN
Public Works Director Daryl Grigsby and Senior Civil Engineer Mike McGuire provided an
in-depth staff report and responded to Council questions.

By consensus, Council directed staff to receive and file the new Facilities Master Plan for
the City of San Luis Obispo .
LIAISON REPORTS AND COMMUNICATIONS
Mayor Harmon indicated that the Sierra Club requesting the Council to adopt a Resolution
opposing trucking oil through San Luis Obispo. By consensus the Council directed staff to
prepare the resolution.
Mayor Harmon indicated she met with the Mayor and staff of the City of Portland and received a
tour of their infrastructure.
Vice Mayor Pease attended a Zone 9 meeting.

B. CONFERENCE WITH LEGAL COUNSEL – ANTICIPATED LITIGATION
Significant exposure to litigation pursuant to paragraph (2) of subdivision (d) of Section
54956.9: No of potential cases: One.
A point has been reached where, in the opinion of the legislative body of the local agency on
the advice of its legal counsel, based on existing facts and circumstances, there is a significant
exposure to litigation against the local agency. The existing facts and circumstances exposing
the City to litigation include the following: A July 20, 2018 letter from Orcutt Associates,
LLC’s attorney threatening litigation regarding the City’s compliance with Reimbursement
Agreement dated November 20, 2007 and amended in July 22, 2011. A copy of the July 20,
2018 letter is on file with the City Clerk’s office.
C. CONFERENCE WITH LEGAL COUNSEL – EXISTING LITIGATION
Paragraph (1) of subdivision (d) of Government Code § 54956.9; Name of case: Sub
Corporation, LTD, and Square Deal Recordings & Supplies, Inc. v. City of San Luis Obispo;
City of San Luis Obispo Fire Department; and Does 1 through 20; San Luis Obispo Superior

CITY ATTORNEY REPORT ON CLOSED SESSION
City Attorney Dietrick stated The Council authorized the City Attorney to defend against the
litigation, once properly served on the City, in the case of Sub Corporation, LTD and Square Deal
Recordings & Supplies, Inc. v. City of San Luis Obispo; City of San Luis Obispo Fire Department;
and Does 1 through 20; San Luis Superior Court Case No. 18CV-0782. The case alleges inverse
condemnation against the City based on allegations of a City policy of employing inappropriate
and/or ineffective fire suppression protocols resulting in the loss of real and personal property of
plaintiffs. The City Council authorized the defense with all members participating on a vote of 5 -
0.
ADJOURNMENT
The meeting was adjourned at 1:00 p.m. Adjourn to a Special Joint City Council and Citizens’
Revenue Enhancement Oversight Commission Meeting to be held on Tuesday, January 10, 2017
at 6:30 p.m., at the Ludwick Community Center, 864 Santa Rosa Street, San Luis Obispo,
California for the purposes of holding a Community Forum to discuss the 2017-19 Goal-Setting
and Budget Process.
The next Regular City Council Meetings are scheduled for Tuesday, January 17, 2017 at 4:00 p.m.

4. 2019 COMMUNITY DEVELOPMENT BLOCK GRANT FUNDING RESERVATION
LETTER
CARRIED 5-0, authorize the Community Development Director to execute the Reservation
Letter authorizing the City to reserve the total allocation of 2019 Community Development
Block Grant funds for Housing/Public Facilities/Economic Development projects, estimated
in t he amount of $294,899, to the Housing Authority of San Luis Obispo and the San Luis
Nonprofit Housing Corporation for property acquisition of an existing home for housing
special needs households that are either homeless or at risk of becoming homeless.
5. 2018 WATER RESOURCES STATUS REPORT
CARRIED 5-0, receive and file the 2018 Water Resources Status Report.
6. FY 2017-18 ANNUAL REPORT ON DEVELOPMENT IMPACT FEES UNDER

1. Approve the draft Memorandum of Understand ing (MOU) with the City of Morro Bay

ACTION: MOTION BY COUNCIL MEMBER CHRISTIANSON, SECOND BY
VICE MAYOR PEASE, CARRIED 5-0 to adopt a Resolution entitled, “A Reso lution of the
City Council of the City of San Luis Obispo, California, denying an appeal (filed by Foothill
Blvd Civil Defense) approving a density bonus and waivers of development standards, and
the use permit approval for a new four-story mixed-use project with 6,800 square feet of
ground floor commercia l/retail space, 78 residentia l units, and 155 parking spaces with a
request for mechanical parking lifts and expanded hours of operation for the commercial
spaces with a categorical exempt ion from environmental review, as represented in the City
Council agenda report and attachments dated January 15, 2019 (790 Foothill Blvd., APPL-
1971-2018)
With the following added Condition:
14. Applicant agrees to provide additional improvements to public facilities in excess of
otherwise applicable project requirements in an amount not to exceed $150,000, which
may to include, but not limited to, one or more of the following:
a. One Additional Street Light beyond the Project Frontage on Foothill between
Broad & Ferrini.
b. One Additional St reet Light beyond the Project Frontage on Foothill between
Chorro & Santa Rosa
c. Expand undergrounding of overhead utilities on Chorro
d. Implement Safe Routes to School Plan Project of Green Bike Lanes Across
Driveways beyond Project Frontage on Foothill between Broad & Ferrini
e. Initiate Parking Permit District Process in vicinity & If approved fund first year of
permit costs.
f. Decorative Brick Pavers in the Hig h Visibility Crossings.

In the event Applicant is required to defend against any legal challenge to any project

A Joint City Council and Citizens’ Revenue Enhancement Oversight Commission (REOC)
Special Meeting was called to o rder on Wednesday January 23, 2019 at 6:08 p.m. in the
Veteran’s Memorial Building, located at 801 Grand Ave, San Luis Obispo, California, by Mayor
Harmon.

meeting with the Revenue Enhancement Oversight Commission as it is an opportunity to provide
feedback on the use of the Local Revenue Measure and act as the Annual Citizen Oversight
Meeting.

2019-21 FINANCIAL PLAN PROCESS AND FISCAL OUTLOOK
Mayor Harmon, Derek Johnson, City Manager and Brigit te Elke, Finance Director presented the
PowerPoint on the 2019-21 Financial Plan process and fiscal outlook.
OPEN HOUSE/WORKSHOP
Mayor Harmon called upon Don Maruska, facilitator, to review the approach for tonight’s
community forum.
All attending participants were provided with an opportunity to “Express their thoughts with
dots!” by applying green sticker dots to posters for their five top priorities for general fund
expenditures and to complete a survey ranking the priorities for Measure G expenditures.

During the public comment period, members of the public provided input on the issues and goals
that were priority to them. Public comments were grouped into the following categories:
