ROLL CALL Council Members Present: Council Members Carlyn Christianson, Aaron Gomez, Erica A. Stewart, Vice Mayor Andy Pease, and Mayor Heidi Harmon. Council Members Absent: None City Staff Present: Derek Johnson, City Manager; Christine Dietrick, City Attorney; and Teresa Purrington, City Clerk; were present at Roll Call. Other staff members presented reports or responded to questions as indicated in the minutes. PUBLIC COMMENT ON CLOSED SESSION ITEMS None. ---End of Public Comment --- CLOSED SESSION A. CONFERENCE WITH LEGAL COUNSEL — ANTICIPATED LITIGATION Significant exposure to litigation pursuant to paragraph (2) of subdivision (d) of Section 54956.9: No. of potential cases: One. A point has been reached where, in the opinion of the legislative body of the local agency on the advice of its legal counsel, based on existing facts and circumstances, there is a significant exposure to litigation against the local agency. The existing facts and circumstances exposing the City to litigation include the following: San Luis Obispo Page I San Luis Obispo City Council Minutes of March 5. 2018 Page 2 In a letter dated February 14, 2019, attorney for the International Association of Firefighters, Local 3523 requested a tolling agreement related to what was described as FLSA regular rate miscalculations by the City. In an email exchange that followed receipt of the letter, the attorney clarified the position of Local 3523 and submitted a Public Records Act Request for information related to employee health benefit payments. Copies of the original letter, email exchange, and records request are on file with the City Clerk's office. CITY FARM 5 YEAR REPORT AND PRESENTATION Bob Hill Interim Deputy Director Office of Sustainability introduced Steven Marx, Executive Director and President of Central Coast Grown who presented the City Farm 5 - year report. 2. C -SPAN CITIES TOUR City Manager Derek Johnson introduced Lisa Ludovici, Charter and Mark Farkas from C - SPAN who presented their San Luis Obispo Weekend Tour plans. WAIVE READING IN FULL OF ALL RESOLUTIONS AND ORDINANCES CARRIED 5-0, to waive reading of all resolutions and ordinances as appropriate. 4. REVIEW MINUTES OF THE FEBRUARY 19, 2019 (1TV COUNCIL Wti,TING CARRIED 5-0, to approve the minutes of the City Council meeting held on February 19, 2019. 5. PUBLIC HEARING - SECOND READING TO ADOPT AN ORDINANCE AMENDING THE AIRPORT AREA SPECIFIC PIAN AND THE CITY'S GENERAL PLAN TO RE -ZONE PROPERTY TO ALLOW FOR A MIXED-USE PROJECT CARRIED 5-0, to adopt an Ordinance entitled, "An Ordinance of the City Council of the City of San Luis Obispo, California, rezoning property at 650 Tank Farm Road from Business Park (BP -SP) and Medium -Density Residential (R -2 -SP) to Service Commercial (C -S -SP) and making associated amendments to the Airport Area Specific Plan to be consistent with the 650 Tank Farm Mixed -Use Project Conceptual Development Plan and with the General Plan as amended." 6. LOW CARBON TRANSIT OPERATIONS PROGRAM GRANT APPLICATION(S) CARRIED 5-0, to adopt a Resolution entitled, "A Resolution of the City Council of the City of San Luis Obispo, California, authorizing the City Manager or their designee, to file, execute and fulfill any related low carbon transportation operations program grant applications, certifications, assurances, forms, agreements, and associated documents on behalf of the City" for transit capital projects. 7. TERRACE HILL PIPELINE AND PRESSURE REGULATING VALVE REHABILITATION PROJECT, SPECIFICATION NO. 91425 CARRIED 5-0, to approve the project plans and special provisions, authorize staff to advertise for bids, and authorize the City Manager to award the construction contract for the bid total if the lowest responsible bid is within the Engineer's Estimate of $420,000. SOUTH HILLS RADIO SITE UPGRADES PROJECT, SPECIFICATION NO. 91584 CARRIED 5-0, to approve the project plans and specifications, authorize staff to advertise for bids, and authorize the City Manager to award the construction contract for the bid total if the lowest responsible bid is within the publicly disclosed funding amount of $650,000. 9. FY 2019-20 GRANT APPLICATION FOR OFFICE OF TRAFFIC SAFETY GRANT P'P n R A M CARRIED 5-0, to: 1. Authorize the Police Department to submit a grant application to the Office of Traffic Safety for a FY 2019-20 Selective Traffic Enforcement Program (STEP) not to exceed $125,000. 2. If the grant is awarded, authorize the Chief of Police to execute all grant related documents and authorize the Finance Director to make the necessary budget adjustments upon the award of the grant. 10. CALLS JOAQUIN LIFT STATION REPLACEMENT, SPEC. NO. 9111$, CONTRACT AMENDMENTS CARRIED 5-0, to: 1. Approve and authorize the Mayor to execute a contract amendment with AECOM for $175,827 for engineering design services for the Callc Joaquin Siphon and Lift Station Replacement, Spec. No. 91118; and 2. Authorize use of project funding for additional environmental permitting services by Terra Verde Environmental Consulting and property acquisition services by Hamner Jewell & Associates for the Calle Joaquin Siphon and Lift Station Replacement. 11. BUDGET REALLOCATION FOR THE POLICE DEPARTMENT REPLACEMENT PROJECT AND SINSHEIMER TENNIS COURT LIGHTING PROJECT CARRIED 5-0, to: 1. Authorize the reallocation of Local Revenue Measure funds for the Police Station Replacement Project; and 2. Approve the following budget transfers: a. $104,000 to the Police Station Replacement Project, Specification No. 91365, from Police Department Space Improvements & Carpet Replacement Project, Specification No. 91557; and b. $20,000 to the Major Facilities Replacement Account, Specification No. 91250, from the Police Department Space Improvements & Carpet Replacement Project, Specification No. 91557; and 3. Authorize the deferment and return $165,000 of unspent funds of the Parkland Funded 2017-19 Sinsheimer Park Tennis Court Lighting Project and direct staff to include discussions of this project concurrent with the update of the Parks and Recreation Element and Master Plan Update. RESOLUTION OF INTENTION AND AN ORDINANCE AUTHORIZING AN AMENDMENT TO THE CONTRACT BETWEEN THE CITY OF SAN LUIS OBISPO AND THE BOARD OF ADMINISTRATION OF THE CALIFORNIA PUBLIC EMPLOYEES' RETIREMENT SYSTEM TO PROVIDE SECTION 20516 (COST SHARING) Human Resources Director Monica Irons and Human Resources Manager Greg Zoeller provided an in-depth staff report and responded to Council questions. Public Comments: None ---End of Public Comment --- ACTION: MOTION BY VICE MAYOR PEASE, SECOND BY COUNCIL MEMBER STEWART, CARRIED 5-0 to: 1. Adopt a resolution of intention entitled "Resolution of Intention to approve an amendment to contract between the Board of Administration California Public Employees' Retirement System and the City Council of the City of San Luis Obispo;" and 2. Introduce an Ordinance entitled "An Ordinance of the City Council of the City of San Luis Obispo, California, authorizing an amendment to the contract between the City Council of the City of San Luis Obispo, California and the Board of Administration of the California Public Employees' Retirement System" approving an amendment to the contract between the Board of Administration of the California Public Employees' Retirement System (CalPERS) and the City of San Luis Obispo. 13. 2019 LEGISLATIVE PLATFORM (SECOND REVIEW) City Attorney Christine Dietrick presented the staff report and answered questions of Council. Public Comments: None ---End of Public Comment --- ACTION: MOTION BY COUNCIL MEMBER CHRISTIANSON, SECOND BY VICE MAYOR PEASE, CARRIED 5-0 to adopt a Resolution entitled, "A Resolution of the City Council of the City of San Luis Obispo, California, establishing the City Legislative Action Platform for 2019 and appointing the Council Member and staff person to act as liaison between the City of San Luis Obispo and the League of California Cities," with the following changes to the Legislative Action Platform: Economic Development Section add 2 back in adding "as a place to locate head of household jobs" at the end of the sentence. Utilities Section add back in #4 and #14 with staffs recommendation. San Luis Obispo City Council Minutes of March 5, 2018 Page 7 STUDY SESSION ITEMS 14. CAL POLY REGIONAL WATER SUPPLY ALTERNATIVES AND SHORT-TERM WATER AGREEMENTS Council Member Stewart recused herself due to the fact that she is employed by Cal Poly and left the hearing room. Interim Utilities Director Aaron Floyd and Utilities Project Manager Jennifer Metz provided an in-depth staff report and responded to Council questions. Public Comments: Cody VanDorn ---End of Public Comment --- By consensus, Council received and filed the update on Cal Poly regional water supply alternatives and provided direction on short-term water supply agreements for outside City deliveries and to broaden the existing General Plan policy to include both non -potable and recycled water supplies. Council Member Stewart rejoined the meeting at 7:50 PM COUNCIL COMMUNICATIONS AND LIAISON REPORTS Mayor Harmon indicated she was interviewed by CSPAN and attended the land conservancy gathering with Vice Mayor Pease and Council Member Gomez. Council Member Stewart indicated she attended a CAPSLO meeting.
