Linked above is a folder containing all records the City of San Luis Obispo has produced to date responsive to Public Record Act Requests related to Penal Code Section 832.7(b) [the
code section modified by SB 1421 – the bill you linked to in your letter]. The City has received several requests for the same or similar records and has posted them at this location
to avoid duplicative work. There are records in the folder from outside the timeframe you’ve specified and the specific charges detailed in your request: “records related to officers
who were disciplined for acts of sexual misconduct or dishonesty between Jan 1., 2014 and Jan. 1, 2019 while with the San Luis Obispo Police Department.”
We interpret your use of “disciplined” to mean “a sustained finding was made” as that term is used related to sexual assault in Penal Code section 832.7(b)(1)(B)(i) and to perjury, false
statements, filing false reports, destruction, falsifying, or concealing of evidence in Penal Code section 832.7(b)(1)(C).
The City has no records responsive under Penal Code section 832.7(b)(1)(B)(i). The City does have records responsive under Penal Code section 832.7(b)(1)(C) which have been provided
at the link above.
Redactions have been made to all records as mandated by Penal Code section 832.7(b)(5)(A) – (D). Should you determine further records are needed, please contact us.
If you require copies of the records in some manner other than the public portal access, please let us know.
Unless we hear otherwise from you, with this production the City will consider your request closed.
