ROLL CALL Council Members Present: Council Members Carlyn Christianson, Aaron Gomez, Erica A. Stewart, Vice Mayor Andy Pease, and Mayor Heidi Harmon. Council Members Absent: None City Staff Present: Derek Johnson, City Manager; Christine Dietrick, City Attorney; and Teresa Purrington, City Clerk; were present at Roll Call. Other staff members presented reports or responded to questions as indicated in the minutes. Other staff members presented reports or responded to questions as indicated in the minutes. PLEDGE OF ALLEGIANCE Council Member Aaron Gomez led the Pledge of Allegiance. CITY ATTORNEY REPORT ON CLOSED SESSION City Attorney Christine Dietrick stated that the Council met in closed session regarding pending litigation Richard R. Vanhumbeck and Southwest Regional Council of Carpenters v. City of San Luis Obispo and City Council of the City of San Luis Obispo, Agera Grove Investments, LLC on a California Environmental Quality Action challenge for the approval of the 650 Tank farm development. The Council voted on a motion by Council Member Christianson, seconded by Council Member Stewart carried 5 – 0 to authorize the City Attorney to defend the City against the writ petition the City will be doing that defense through outside counsel, Rick Jarvis. The Council also authorized the retention of and professional services agreement with Mr. Jarvis. No further actionable items were discussed. PRESENTATIONS 1. PROCLAMATION - MONTH OF THE CHILD AND CHILD ABUSE PREVENTION MONTH (HARMON – 5 MINUTES) Mayor Harmon presented a proclamation to Melinda Sokolowski, CAPSLO Family Support Services for Month of the Child and Child Abuse Prevention Month. REVIEW MINUTES OF THE MARCH 7, 2019 (12:00, 3:30 AND 4:30 CLOSED SESSIONS) AND MARCH 19, 2019 CITY COUNCIL MEETINGS CARRIED 5-0 to approve the minutes of the City Council meetings held on March 7, 2019 (12:00, 3:30 and 4:30 Closed Sessions) and the Regular Meeting held on March 19, 2019. 5. APPROVAL OF THE FINAL MAP FOR TRACT 3111, 3750 BULLOCK (SBDV- 1225-2017) CARRIED 5-0 to adopt a Resolution entitled, “A Resolution of the City Council of the City of San Luis Obispo, California, approving the Final Map for Tract 3111, 3750 Bullock Lane (SBDV-1225-2017)” San Luis Obispo City Council Minutes of April 2, 2019 Page 4 6. REQUEST FOR PROPOSALS – BUILDING AND SAFETY, ENGINEERING DEVELOPMENT REVIEW, FIRE PLAN REVIEW AND INSPECTION SERVICES CARRIED 5-0 to: 1. Approve a Request for Proposals to provide plan check services to supplement building resources, engineering development review, fire plan review and inspection services to maintain processing times per Specification No. 2019-4006-01; and 2. Authorize the City Manager to execute agreements with the selected consulting firms; and 3. Authorize the Finance Director to execute and amend Purchase Orders for individual consultant service contracts in an amount not-to-exceed the authorized project budgets. 7. RECRUITMENT AND HIRING INCENTIVE PROGRAM REVISIONS CARRIED 5-0 to adopt a Resolution entitled, “A Resolution of the City Council of the City of San Luis Obispo, California, adopting the Relocation and Hiring Incentive Program and Employee Referral Program, and superseding any prior resolutions or policies in conflict.” 8. ADVERTISE THE EL CAPITAN BRIDGE REPLACEMENT PROJECT CARRIED 5-0 to approve the El Capitan Pedestrian Bridge Replacement project, Plans and Specifications; appropriate $100,000 in SB1 funding to the project; and authorize staff to advertise for bids. 9. ADVERTISE SOUTH BROAD STREET IMPROVEMENTS CARRIED 5-0 to approve the project and specification plans for the South Broad Street Improvements, Specification Number 1000023; and authorize staff to advertise for bids; and appropriate $1,175,000 in State gas tax SB1 funds to the project; and authorize the City Manager to award the construction contract for the bid total if the lowest responsible bid is within the publicly disclosed funding amount of $2,400,000. 10. ADVERTISE THE STAFFORD/KENTUCKY SEWER LINE REPLACEMENT PROJECT CARRIED 5-0 to approve the Stafford/Kentucky Sewer line Replacement project plans and specifications; and authorize staff to advertise for bids; and authorize the City Manager to award the construction contract if the lowest responsible bid is within the publicly disclosed funding amount of $768,000; and approve the transfer of $250,000 from the Sewer Fund Undesignated Capital account to the project account. 11. FARMERS MARKET SAFETY BOLLARD PROJECT CARRIED 5-0 to approve the suggested devices and locations for the “Farmer’s Market Safety Bollard Project, Specification No. 91673,” and; authorize staff to advertise for construction bids; and authorize the City Manager to award a contract if the total of the bid plus contingency is within the available project estimate of $850,000. PUBLIC HEARING - ESTABLISHMENT OF THE SAN LUIS RANCH COMMUNITY FACILITIES DISTRICT NO. 2019-1 Department Director Michael Codron provided an in-depth staff report and responded to Council questions. Public Comments: Walter Heiberg ---End of Public Comment--- ACTION: MOTION BY VICE MAYOR PEASE, SECOND BY COUNCIL MEMBER CHRISTIANSON, CARRIED 5-0 to adopt a Resolution entitled, “A Resolution of the City Council of the City of San Luis Obispo, California, modifying Resolution of Intention and approving amended and restated rate and method of apportionment.” ACTION: MOTION BY COUNCIL MEMBER CHRISTIANSON, SECOND BY COUNCIL MEMBER GOMEZ, CARRIED 5-0 to:  Adopt a Resolution entitled, “A Resolution of the City Council of the City of San Luis Obispo, California, of formation of the City of San Luis Obispo Community Facilities District No. 2019-1 (San Luis Ranch), authorizing the levy of a special tax within the community facilities district and establishing an appropriations limit for the community facilities district.”  Adopt a Resolution entitled, “A Resolution of the City Council of the City of San Luis Obispo, California, deeming it necessary to incur bonded indebtedness within the City of San Luis Obispo Community Facilities District No. 2019-1 (San Luis Ranch).”  Adopt a Resolution entitled, “A Resolution of the City Council of the City of San Luis San Luis Obispo City Council Minutes of April 2, 2019 Page 6 Obispo, California, calling special election for City of San Luis Obispo Community Facilities District No. 2019-1 (San Luis Ranch)." ACTION: MOTION BY COUNCIL MEMBER GOMEZ, SECOND BY COUNCIL MEMBER CHRISTIANSON, CARRIED 5-0 to: • Adopt a Resolution entitled, "A Resolution of the City Council of the City of San Luis Obispo, California, declaring results of special election and directing recording of notice of special tax lien." ■ Introduce an Ordinance entitled, "An Ordinance of the City Council of the City of San Luis Obispo, California, levying special taxes within the City of San Luis Obispo Community Facilities District No. 2019-1 (San Luis Ranch).' 14. PUBLIC HEARING - ORDINANCE INTRODUCTION TO APPROVE THE FIRST AMENDMENT TO THE AVILA RANCH DEVELOPMENT AGREEMENT Department Director Michael Codron provided an in-depth staff report and responded to Council questions. COUNCIL COMMUNICATIONS AND LIAISON REPORTS Mayor Harmon indicated she attended the Women of Distinction event, and the CAPSLO Super Hero run. Vice Mayor Pease indicated attending the Housing Summit, and the Water Conservation Showcase in San Francisco. Council Member Christianson indicated she will be attending the Homeless Services Oversight Council where they will be making funding recommendations for HEAP grant funds.
