CALL TO ORDER
A Regular Meeting of the San Luis Obispo City Council was called to order on Tuesday, May 21,
2019 at 5:30 p.m. in the Council Chamber, located at 990 Palm Street, San Luis Obispo, California,
by Mayor Harmon.

A Regular Meeting of the San Luis Obispo City Council was called to order on Tuesday, May 21,
2019 at 6:00 p.m. in the Council Chamber, located at 990 Palm Street, San Luis Obispo, California,
by Mayor Harmon.

CITY ATTORNEY REPORT ON CLOSED SESSION
City Attorney Dietrick stated Council provided direction but no other reportable action was
provided for Closed Session Item A.
PRESENTATIONS
1. PROCLAMATION - HUNGER AWARENESS DAY
Mayor Harmon presented a Proclamation to Kevin Drabinski, CEO, Food Bank Coalition of
San Luis Obispo County, declaring June 7, 2019 as "Hunger Awareness Day.”
2. PROCLAMATION - PUBLIC WORKS / UTILITIES WEEK
Mayor Harmon presented a Proclamation to Daryl Grigsby, Public Works Director and Aaron
Floyd, Utilities Director, declaring May 19-25, 2019 as "National Public Works and Utilities
Week.”
3. PROCLAMATION - BUILDING AND SAFETY MONTH
Mayor Harmon presented a Proclamation to Eric Hagen, Chief Building Official, City of San
Luis Obispo, declaring May 2019 as "Building Safety Month.”

City Attorney, Christine Dietrick, introduced the new Assistant City Attorney, Charles Bell.

City Clerk Purrington presented the contents of the report.

1. Abe Lincoln - Human Relations Commission; to complete an unexpired term through

2. Kari Applegate - Parks and Recreations Commission; to complete an unexpired term
through March 31, 2023, and
3. Kristin Battaglia - Tourism Business Improvement District Board; to complete an
unexpired term through March 31, 2023.

MEMBER GOMEZ, CARRIED 5-0 to approve Consent Calendar Items 4 thru 14.
4. WAIVE READING IN FULL OF ALL RESOLUTIONS AND ORDINANCES
CARRIED 5-0, to waive reading of all resolutions and ordinances as appropriate.
5. MINUTES OF MAY 7, 2019
CARRIED 5-0, to approve the Minutes of the City Council meeting of May 7, 2019.
8. ALLOW FOR ALTERNATE FORMS OF IDENTIFICATION OR A DEPOSIT TO BE
USED FOR ESTABLISHMENT OF UTILITY ACCOUNTS
CARRIED 5-0, to adopt a Resolution entitled, “A Resolution of the City Council of the City
of San Luis Obispo, California, rescinding and replacing Resolution No. 10904 (2018 series)
to establish a reconnection fee and refundable deposit requirements.”
9. MICROSOFT OFFICE 365 RENEWAL
CARRIED 5-0, to approve contract renewals, authorize waiver of formal bids through a
cooperative agreement, and authorize the City Manager to approve related Purchase Order
requisitions for Microsoft Office 365 Government Plan subscription licenses through the
2019-21 Financial Plan.
10. 2018/19 SENATE BILL 1 (SB1) STATE OF GOOD REPAIR TRANSIT GRANT
APPLICATION
CARRIED 5-0, to adopt a Resolution entitled, “A Resolution of the City Council of the City
of San Luis Obispo, California, authorizing the execution of the certifications and assurances
for the California State of Good Repair Program” and authorize the City Manager to enter
into a Sole Source Agreement with Genfare for new fareboxes.
11. WATER ENERGY EFFICIENCY PROJECT – CALIFORNIA INFRASTRUCTURE
AND ECONOMIC DEVELOPMENT BANK (IBANK) FUNDING RESOLUTION
CARRIED 5-0, to adopt a Resolution entitled, “A Resolution of the City Council of the City
of San Luis Obispo, California, authorizing the submission of the application to the California
Infrastructure and Economic Development Bank (IBank) for financing the Water Energy
Efficiency Project, authorizing the incurring of an obligation payable to IBank for the
financing of the Water Energy Efficiency Project if IBank approves said application,
Declaration of Official Intent to reimburse certain expenditures from proceeds of obligation,
and approving certain other matters in connection therewith,” and authorize the Director of
Utilities to execute the financial assistance application for the Water Energy Efficiency
Project.

12. REVIEW OF A MILLS ACT HISTORICAL PROPERTY CONTRACT FOR THE
MONDAY CLUB – 1815 MONTEREY STREET
CARRIED 5-0, to adopt a Resolution entitled, “A Resolution of the City Council of the City
of San Luis Obispo, California, approving a Historic Property Preservation Agreement
between the City and the owner of The Monday Club at 1815 Monterey Street (Application
No. HIST 2034-2019).”
13. ADVERTISE THE FOOTHILL PIPE BURST PROJECT, SPECIFICATION NO.
91640
CARRIED 5-0, to:
1. Approve the project plans and specifications for the Foothill Pipe Burst Project,
Specification Number 91640; and
2. Authorize staff to advertise the Project for bids; and
3. Authorize the City Manager to award the construction contract if the lowest responsible
bid is within the Engineer’s Estimate of $220,000; and
4. Approve the transfer of $150,000 from the I/I Reduction Funds (91739) account to the
project account.
14. CLIMATE ACTION PLAN CONTRACT AMENDMENT
CARRIED 5-0, to approve a contract amendment with Raimi + Associates in the amount of
55,000 for a total contract amount of $149,993.
PUBLIC HEARING ITEMS AND BUSINESS ITEMS
15. PUBLIC HEARING – AMEND THE LAND USE DESIGNATION OF THE NORTH-
WEST CORNER OF TANK FARM AND BROAD (3985 BROAD ST, 660 TANK
FARM RD) – NOTICED AS A CONTINUED ITEM FROM THE MAY 7, 2019 CITY
COUNCIL MEETING
This item has been continued to a date uncertain.
16. MEMORANDUM OF UNDERSTANDING BETWEEN THE CITY OF SAN LUIS
OBISPO, THE COUNTY OF SAN LUIS OBISPO, AND 1144 HIGUERA
INVESTMENTS LLC FOR A POTENTIAL PUBLIC-PRIVATE PARKING
STRUCTURE IN THE UPPER DOWNTOWN
Deputy City Manager Greg Hermann please introduce the item, and Economic Development
Manager Charlene Rosales and Public Works Deputy Director Tim Bochum please present the
report.

ACTION: MOTION BY COUNCIL MEMBER VICE MAYOR PEASE, SECOND
BY COUNCIL MEMBER CHRISTIANSON, CARRIED 5-0 to:
1. Authorize the City Manager to execute a Memorandum of Understanding between the
City of San Luis Obispo, County of San Luis Obispo, and 1144 Higuera Investments,
LLC; and
2. Approve a new capital project "Higuera Parking Structure" and direct the Public Works
Department to engage in design -build project delivery (Phase 1) with the County and
allocate $90,000 in matching funds to the County for Phase I activities; and
3. Authorize the City Manager, or his designee, to negotiate final terms for a Ground Option
Lease and Final Lease Option for the project and return to Council with final
recommendations for consideration; and
4. Authorize the Public Works Director to exercise, if necessary, any termination clauses in
the MOU.
COUNCIL COMMUNICATIONS AND LIAISON REPORTS
Mayor Harmon attended Bike to School and Bike to Work, the State of the City, and the U-40
event on Good Governance. She also spoke to Cal Poly students about Community Choice Energy
Vice Mayor Pease announced that the Latino Outreach Council is having a forum on Housing on
May 28, 2019 at the County Government Center.
Council Member Stewart attended CAPSLO board meeting and encouraged Council to review
the mid -year report. She also announced that SLO County Diversity Commission is having
Jessica Lynn speak in Grover Beach on Thursday, May 23, 2019
ADJOURNMENT
The meeting was adjourned at 7:40 p.m. The next Regular City Council Meeting is scheduled for
Tuesday, June 4, 2019 at 6:00 p.m., in the Council Chamber, 990 Palm Street, San Luis Obispo,
California.
