The Public Records Act does not require the City to respond to questions, therefore the City has no response to the additional questions in your request and refers you to the City’s prior public statements regarding this incident. 7/19/2019 PRR19302 Velie – Gun loss phone records and recordings From: Karen Velie <velieslo@gmail.com>   Sent: Friday, July 19, 2019 12:45 PM  To: Cantrell, Deanna <DCantrel@slocity.org>  Cc: Dietrick, Christine <cdietric@slocity.org>; Johnson, Derek <djohnson@slocity.org>  Subject: Records request  Chief Deanna Cantrell   Under the Public Records Act, I am asking for your cell phone records and the records of all police dispatchers cell phones, who discussed your gun on July 10, 2019 from 11:30 a.m. until 11:45 p.m. I am also asking for the copies of the voice recordings of calls to dispatch from 12:15 p.m. through 3 p.m. on July 10, 2019 made by you or anyone regarding your gun. I am also asking for a copy of your report to the stolen property system about your gun loss. Pursuant to Government Code section 6254(f), “Records of complaints to, or investigations conducted by…any state or local agency....” are exempt from disclosure. See also Haynie v Superior Court (2001) 26 C. 4th. Any phone calls and/or voice recordings of calls to dispatch regarding this case are either records of a complaint to the San Luis Obispo Police Department or part of the investigation conducted in this case and are therefore exempt from disclosure. A copy of the public log for this incident and a Summary Sheet, which includes information required to be released per Government Code section 6254(f) is attached. With regard to Automated Firearms System (APS) reports, the reporting of the lost or stolen firearm is part of our investigation and/or an otherwise exempt law enforcement record under Section 6254(f) as well. Moreover, while the City has reporting obligations to that system, the reports created and maintained in that system are not records that the City controls or maintains and, to the extent that we have authorization to access those documents, they are part of CLETS and cannot be distributed to persons other than those with a valid law enforcement right and need to know, per Penal Code 11142.
