Recommendation:
Receive and file the Monterey Bay Community Power - Morro Bay and San Luis Obispo
Community Outreach Plan and a presentation from Monterey Bay Community Power about
the enrollment process for the January 2020 launch.

Presentation by Mayor Harmon recognizing Drive Electric Week.
4. INTRODUCE PUBLIC WORKS STAFF (GRIGSBY - 5 MINUTES)
Daryl Grigsby, Public Works Director, will introduce recently promoted staff.
5. PROCLAMATION - DARYL GRIGSBY RETIREMENT (JOHNSON - 5 MINUTES)
Recognition of Daryl Grigsby, Public Works Director, for his outstanding service to the City
of San Luis Obispo upon his retirement.
6. APPOINTMENT TO THE TOURISM BUSINESS IMPROVEMENT DISTRICT
(HERMANN/PURRINGTON - 5 MINUTES)
Recommendation:
As recommended by the Council Subcommittee, confirm the appointment of John C. Conner to
the Tourism Business Improvement District to complete an unexpired term through March 31,
2020.

PUBLIC COMMENT PERIOD FOR ITEMS NOT ON THE AGENDA (not to exceed 15
minutes total)
The Council welcomes your input. You may address the Council by completing a speaker slip
and giving it to the City Clerk prior to the meeting. At this time, you may address the Council
on items that are not on the agenda. Time limit is three minutes. State law does not allow the
Council to discuss or take action on issues not on the agenda, except that members of the
Council or staff may briefly respond to statements made or questions posed by persons
exercising their public testimony rights (Gov. Code sec. 54954.2). Staff may be asked to
follow up on such items.
CONSENT AGENDA
Matters appearing on the Consent Calendar are expected to be non-controversial and will be
acted upon at one time. A member of the public may request the Council to pull an item for
discussion. Pulled items shall be heard at the close of the Consent Agenda unless a majority of
the Council chooses another time. The public may comment on any and all items on the
Consent Agenda within the three minute time limit.
7. WAIVE READING IN FULL OF ALL RESOLUTIONS AND ORDINANCES

Recommendation:
Waive reading of all resolutions and ordinances as appropriate.
8. DRAFT MINUTES REVIEW - AUGUST 20, 2019 CITY COUNCIL MEETING
(PURRINGTON)
Recommendation:
Approve the minutes of the City Council meeting held on August 20, 2019.
9. SECOND READING OF ORDINANCE NO. 1665 (2019 SERIES) RELATED TO
MAINTENANCE AND INSPECTION OF PRIVATE SEWER LATERALS AND
WASTEWATER FLOW OFFSET REQUIREMENTS (FLOYD/HIX)
Recommendation:
Adopt Ordinance No. 1665 (2019 Series) entitled “An Ordinance of the City Council of the
City of San Luis Obispo, California, amending Chapter 13.08 of the Municipal Code related
to Maintenance and Inspection of Private Sewer Laterals and Wastewater Flow Offset
Requirements”

10. APPROVAL OF SOLE-SOURCE PURCHASE FOR TRANSIT (BUS) FUEL FROM
LOCAL SUPPLIER J.B. DEWAR (ELKE/CLANCY)
Recommendation:
Adopt a Resolution entitled, “A Resolution of the City Council of the City of San Luis
Obispo, California, modifying purchasing procedures for the procurement of diesel fuel for
City Transit Operations.”
11. AWARD CASA / STENNER / MURRAY WATERLINE REPLACEMENT,
SPECIFICATION NO. 91312 (GRIGSBY/NGUYEN)
Recommendation:
1. Award a contract to S. Chaves Construction in the amount of $1,616,256 and authorize
the Mayor to execute the contract; and
2. Approve a budget transfer of $690,197 from the Waterline Replacement 2016 Project
(91436) to the Casa/Stenner/Murray Waterline Replacement Project Account (91312).
12. COMMUNITY WILDFIRE PROTECTION PLAN (AGGSON/BLATTLER)
Recommendation:
Receive and file the City’s first Community Wildfire Protection Plan.
13. SECOND READING OF ORDINANCE NO. 1666 (2019 SERIES) RELATED TO
ESTABLISHING LOADING ZONES THROUGH MARKINGS AND SIGNAGE
AND ESTABLISHING TIME LIMITS BY RESOLUTION (GRIGSBY/BOCHUM)
Recommendation:
Adopt Ordinance No. 1666 (2019 Series) entitled, “An Ordinance of the City Council of the
City of San Luis Obispo, California, amending Municipal Code, Title 10 Vehicles and
Traffic Regulations.”
14. COUNTY OF SAN LUIS OBISPO PRADO ROAD INTERCHANGE FUNDING
AGREEMENT (GRIGSBY/HUDSON)
Recommendation:
Approve an agreement with the County of San Luis Obispo for its contribution of
$1,435,260 for its fair share of construction of the Prado Road Interchange and authorize the
City Manager to execute the agreement.

15. OPPOSE PROPOSED NEW OIL AND GAS DRILLING AND HYDRAULIC
FRACTURING LEASE SALES IN THE VICINITY OF THE CITY OF SAN LUIS
OBISPO (HERMANN/HILL)
Recommendation:
Adopt a Resolution entitled, “A Resolution of the City Council of the City of San Luis
Obispo, California, opposing new Oil and Gas Drilling and Hydraulic Fracturing lease sales
in the vicinity of the City of San Luis Obispo that are inconsistent with current use and
jeopardize water resources, air quality and San Luis Obispo Climate Action Plan goals.”
16. AUTHORIZE SUSTAINABLE AGRICULTURAL LANDS CONSERVATION
GRANT APPLICATION FOR OPEN SPACE PROTECTION (HERMANN / HILL)
Recommendation:
Adopt a Resolution entitled, “A Resolution of the City Council of the City of San Luis
Obispo, California, approving the Agricultural Conservation Easement proposal to the
California Strategic Growth Council’s Sustainable Agricultural Lands Program,
administered by the California Department of Conservation for the Miossi Brothers La
Cuesta Ranch Conservation Easement Project.”
PUBLIC HEARING AND BUSINESS ITEMS
17. BOB JONES TRAIL (CALLE JOAQUIN TO OCEANAIRE) ALIGNMENT –
BICYCLE TRANSPORTATION PLAN UPDATE
(GRIGSBY/FUKUSHIMA/SCHWARTZ – 30 MINUTES)
Recommendation:
Adopt a Resolution entitled, “A Resolution of the City Council of the City of San Luis
Obispo, California, amending the Bicycle Transportation Plan (amended 2017) to update the
Bob Jones Trail (Prado to Calle Joaquin) segment project including an amendment to the
Negative Declaration of Environmental Impact (GPI/71-13).”

18. PUBLIC HEARING - CONSIDERATION OF A RESOLUTION ESTABLISHING A
CLEAN ENERGY CHOICE POLICY AND IMPLEMENTATION MEASURES
INCLUDING AN ORDINANCE APPROVING LOCAL AMENDMENTS TO THE
ENERGY CODE; AND AN ORDINANCE IMPLEMENTING A CARBON OFFSET
REQUIREMENT WITH AN IN-LIEU FEE OPTION
(CODRON/HILL/READ – 90 MINUTES)
Recommendation:
1. Adopt a Resolution entitled “A Resolution of the City Council of the City of San Luis
Obispo, California, establishing a ‘Clean Energy Choice Policy’ to guide the reduction
of greenhouse gas emissions and use of fossil fuels for buildings and transportation;” and
2. Introduce an Ordinance entitled “An Ordinance of the City Council of the City of San
Luis Obispo, California, establishing the Clean Energy Choice Program by amending the
City of San Luis Obispo Building Code to require higher energy performance for newly
constructed structures;” and
3. Introduce an Ordinance entitled “An Ordinance of the City Council of the City of San
Luis Obispo, California, implementing the Clean Energy Choice Program by amending
the Municipal Code to establish a carbon offset program for new buildings;” and
4. Direct staff to develop an implementation plan for the Clean Energy Choice Policy to
include 1) identification of appropriate in-lieu fee amounts for various building types, 2)
community education and outreach, 3) development of a program making professional
consultation and design services available to property owners, and 4) identification of a
series of incentives, such as permit streamlining and property development standard
allowances (for example, parking reductions and building height allowances) in
exchange for all-electric development, and return to the City Council for approval
(currently scheduled for November 5, 2019); and
5. Direct staff to submit the approved local amendments to the California Energy
Commission to initiate the Reach Code review and approval process; and
6. Direct staff to submit a letter to Monterey Bay Community Power to drive support for
energy programs that support all electric development.
LIAISON REPORTS AND COMMUNICATIONS
(Not to exceed 15 minutes) Council Members report on conferences or other City activities.
At this time, any Council Member or the City Manager may ask a question for clarification,
make an announcement, or report briefly on his or her activities. In addition, subject to
Council Policies and Procedures, they may provide a reference to staff or other resources for
factual information, request staff to report back to the Council at a subsequent meeting
concerning any matter, or take action to direct staff to place a matter of business on a future
agenda. (Gov. Code Sec. 54954.2)

The next Regular City Council Meetings are scheduled for Tuesday, September 17, 2019, Closed
Session at 5:00 p.m., and open public session at 6:00 p.m., and will be held respectively in the
Council Hearing room and Council Chamber, 990 Palm Street, San Luis Obispo, California.
